Newbie - Advice needed - Selling house to clear debt
goldyal
We are moving to another part of the UK and have an existing IVA for £42K with 4 years to run.
WE will realise some money from the sale of our house but don't want all of it to go to the IVA. Also we have reservations about the insolvency practitioner, for example, it took them 7 month to post the IVA with the courts. They also accused us of lying on several occasions but this was resolved when we produced documentation to show we had provided them with information as requested.
My questions are;
1/ Can we negotiate with the IVA to pay early at a reduced level.
2/ Is there a body, organisation, that will represent me to the IVA practitioner?
3/ Can I in retrospect claim back any charges made by the banks (charges), credit card (charges) and loan providers (a 12% default charge) under the IVA.
Thanks in advance for any advice.

Hey,
Thanks for your time in posting. Thanks very much.0 -
You're asking tough questions, and those who are into IVAs won't pick up from your title that this is about IVAs.
If you can't get answers from this board, and I don't feel confident to answer these questions, then try:
The Insolvency Practitioners Association
52 - 54 Gracechurch Street

You might find that your IP isn't registered with this body but they should still be able to point you in the right direction.0 -
Erm not sure. I think if you get money, it is meant to go to your creditors? Really bumping for the more knowledgeable people
chevI want a job that is less than an hour driving away from my house! Are you listening universe?

Thanks all for bumping. I realise that these are not the normal questions I've seen on the forums (although a newbie I have been looking on this forum for some time).
I worked out that the NPV for 42K would be 32.5K (ish) dependent on 5% apr and an offer above 32K may be accepted.0 -
you can definitely claim back all of the bank charges and cc charges for the last 6 years....Martin has an article about it and the consumers action group website have standard letters you can use. Have a go....my daughter claimed back £3400 from HSBC and it wasn't difficult. GOOD LUCKWombling £457.410
