Hoping I'm in the right section here, but I'm after a letter template to send to a lender who had wrongfully listed a default against me. Obviously I want this removed as I have never heard of them company let alone purchased any of their items but I am not sure how to word it.
Any help appreciated and thank you all in advance.

First of all, you should ask for a clarification of their action because they could be a DCA collecting on behalf of an original lender or a parent company of a trader with whom you may have defaulted. You could try a subject access request similar to the one you can find on the CAG board. You will have to enclose a cheque for £10 for the information.
Next, if you find that the entry was made in error try something along the lines of:
Dear Sir/Madam,
I note that you have entered a default against me on Date with Credit reference Agency. This was entered in error because I have never had a debt with your company nor was I ever contacted to remedy the situation. This is contrary to the consumer act 1974.
Therefore, I can only assume that this was either an administration error on your part or a case of mistaken identity, either way you are requested to cancel the consequential listing with the above reference agency. An "amendment" or "alteration" will not be sufficient.
Failure to comply will result in a complaint to the Finacial Services Ombudsman and legal action to recover all costs incurred as a result of your action including, but not limited to, the additional interest I have had to pay on loans as a consequence of your entry.
Yours faithfully
Your Name
Personally, I'd ring them up first and if they give you the runaround you could threaten legal action then. Insert your own details where the red bits are.[strike]-£20,000[/strike] 0!0 -
Thanks Dr.Shoe
Can't call them as after a bit of investigation work I have found out that the company went bust a couple of years ago. Was thinking of writing to the company that took over, what do you think?0 -
How old are these debts?
If the original company was declared, or declared themselves, Bankrupt, were you contacted by the Official Receiver?
I would be a little wary of contacting the new company, as they may not own the debt.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi Rog2,
Well the C&G says that it's 3yrs old and nope I wasn't contacted by anybody. I only found out who the company were and that they had gone bust by looking on the internet.
mmmm, dont want it on my file but dont know how to get it off. Does anybody know how you go about putting a notice of correcton on your file?
Thanks0 -
I'm not entirely clear here.... are you saying there is a default on your record from a company that no longer is in business?
if so i would suggest you contact the credit agency and Dispute the entry (not a notice of correction but dispute) .They should contact the company and respond within 28 days . Obviously if the co. isn't in business then presumably that wont get an answer and should remove your default0 -
Hi Clapton, thats right, the default is with a company that no longer exists - Tiny Computers. I am told that the £40 has been paid but I myself have never made a payment to Tiny Computers.0
