Data Protection Act -After 40 Days?

Hi Everyone,

Only just found this forum and looks like I've got ALOT of reading ahead of me. I was trying to help my mother out with her bank charges after she was hit with £250 charges in one go. We sent a letter off to the bank asking for her bank statements for the last 6 years under the Data Protection Act. It has been over 40 day now since they received the request. We phoned them up last week and they said because they have two different addresses on their records (her old address and her present address), they didn't know which address to send them to... they never even attempted to contact her. So its now been a further week and still no statements, can anyone help me on how to instruct me mother from here?

Thanks
Steve

Try the above Steve - lots of advice.
Another useful website is https://www.penaltycharges.co.uk - again lots of advice and templates.

Sounds like your bank are just stalling for time.

Write to the Information Commissioner's office. Virgin Holidays gave me the runaround last year (they not only ignored me but then sent me a pack of lies) and I wrote to the IC's office (not expecting any good to come of it I have to say).

They ripped right into Virgin; all of a sudden all the data I'd requested that Virgin had adamantly claimed had previously been destroyed was supplied in full

Any advice that you receive from me is worth exactly what you paid for it. Not a penny more or a penny less.
  • That's great, thanks very much. I should have looked a bit harder before I posted  I like the idea of the 8% APR as well.

Hopefully my mum will see some justice at the end, she works hard in three jobs and every penny matters when your on a low income. I've just found out that shes's been paying two car insurance polices each month because her last insurer renewed her policy without her permission. So this will be another question to ask in the appropriate section - makes me angry that she's getting the p*ss ripped out of her.
