As SarEl says a grey area.

However, if the other party becomes aware that a recording exists it can help to make them more honest with their evidence for fear of perjury.

we did check this, and was advised that if we used the tapes as transcripts it would be allowed, the recordings were made because my husband was concerned about the threats and bullying and wanted to keep evidence of it, he has a whole filing cabinet full of diaries, tapes etc. I am hoping that the ex-employers will panic if they know these tapes exist, as I am sure they wouldnt want them to be heard in court. Either way, they made the threats and cant deny that

  • oh, forgot to say, we received a copy of the response today, and as expected, they have adopted a threatening manner (ironic, seeings as my husband has complained of threats/bullying from the company!) they are saying hub should withdraw his claim or else be hit with the other sides legal fees. I was warned that they would try that

Tape recordings made without consent are a huge grey area, but generally tribunals will not allow them unless there is a matter of "public interest" (there is case law on this aspect). It is up to each individual tribunal to make a decision, but most will not accept them because such recordings infringe other laws, and make any judgement they make subject to appeal.

actually, because of the nature of the company, which I really wish I could name, but obviously I cant! I think it would most definitely be in the publics interest to know what goes on behind the scenes, it would definitely be newsworthy, no doubt about it, so am keeping my fingers crossed

  • Hi SP ,

Get yourself ready for an extremely stressfull time now then , your hubbys ex-employers could drag this out for months even years , as in my case .
Make sure your prepared for the lies and threats that will follow . My advice would be to get on with your lives and spend no more time on your claim than you really have to , difficult I know but you need to realise that the Tribunal Service will not help in anyway when your ex=employer misses deadlines and fails to comply with Orders .....they'll just give them more time . Good Luck
