Please please help

ive had someone put a judgement in against me and got a letter this morning saying they have enforced the judgement and baliffs will be coming round if not paid by 19th

this is a CCJ process and i just dont have the money to pay. can i set something up with the baliffs or has it gone too far?? its my moms house and there is enough stress as it is

please please help

    im shaking here so if anyone can help id apreciate it. im on a dmp with payplan, could they sort this out for me or have ai been an idiot. i have tried to contact the people but to no avail so they havent been helpful
  • Hi, I don't really have an answer for you hun but calm down everything will be fine. Phone CCCs and they'll be able to tell you more. It could just be scare tactic or if they do visit they can't force entry and they can't take if you don't have.

    Did you receive a court summons?
    If so, you would have had the option of making payment by instalments, which would have been considered by the judge.
    When was the CCJ issued?
    Normally, you would have 28 days, from the issue of the judgement, in which you may either pay the judgement in full, or to make an offer of payment.
    Do you know which court the CCJ was issued from?
    If so, contact the court and check your options.
    Do you know your rights concerning bailiffs?
    If not - look at the insolvency helpline:

    I have heard before, that some debt collection agencies, send out official looking letters, threatening this, when in fact no judgement has been made. They may just be trying it on. If you are on a DMP, then Payplan should be able to help you. When you first set it up, did all your creditors agree to the plan, (ie freeze the interest, and agree to the payments). If they ALL did, and you have been paying the money to payplan faithfully every month, then I don't see how any of your creditors would want to issue a CCJ.

    Like I said please check this carefully, before taking action. If anyone does come to the house, do not let them in, they do not have right of entry. So really you must phone Payplan asap and see if they can shed some light on it.

    Don't even open the door as that is seen as giving them permission to enter.

    I was told at CAB last week that this is the procedure for sending bailiffs:

    First they have to take you to court for a CCJ, the court will tell you how much you have to pay each month. Only if you fail to pay this amount can the company go to court for an order to send in bailiffs.
    Unless I say otherwise 'you' means the general you not you specifically.

    this is from court.

    it is from an individual person who i couldnt afford to pay, it has now been passed to the birmingham court instead of northampton where the original claim was. i have tried to get in touch with the person to no avail

    i think this letter is genuine, its from the courts not a DCA, payplan aint open till monday :(

    didnt get a summons no, just the form but they have refused any payment scheme ive offered

    You must reply to the court - not the individual. There should be a telephone number on the letter.
    Does it state on the letter the date of the hearing, or the date of the CCJ?
    Look at the info on bailiffs that I gave you.
    They have no right to enter your mother's house, unless invited.
    They have no right to take anything that is not yours.
    I think you need to go back to CAB for more clarification - or tell us exactly what the letter says.

    Thanks a lot for the site. the letter says that it has been passed from the northampton county court to my local one and that i have 7 days to pay.

    rog2 thanks for that website. it says on there that they give me 7 days notice before a baliff will be coming around to get the money. it also says i can apply for it to be suspended by filling out form N245 but this costs £30 and i just havent got it. they said you can apply individually to get the fee waived which to be honest i really need. i spose i should fill out these forms and go to my local court as soon as i can which is tuesday.

    the main thing it says is to get it out the hands of the baliffs as soon as possible. Im on a DMP as already stated and only just started a new job and pay is not great. i litterally have no money and just feel so down its untrue

    might go and ring the national debtline at the phone box, i need to do something as im nearly crying and just feel like doing summin i may regret like having a drink and ive been off it for over 5 years :(
