Hi this is my first time here so bear with me
Since august i have been recieving letters from a company called JB debt recovery asking for over £500 off me. They say they bought the debt from kays catalogue. I have kays statements saying my account is clear,i also phoned kays today and they assured me my account is clear and they haven't passed my name to JB. I went to c.a.b and the bloke there told me i was the second person to go in today with the same company name. Has anyone got any advice for me as they have threatened me with court action thanks.:eek:

I think you should point out to JB that you have no debt whatsoever to either their company or the company they purport to be collecting for. Ask for written confirmation that the matter will be dropped and give them 14 days to agree with your assertion or provide documentary evidence to the contrary.
Even if you had a debt to Kays it would not be enforceable in court as Kays generaly do not bother with getting you to sign an agreement. This makes it improperly executed under the consumer credit act and so unenforceable.
The law is set to change but will not be changed retrospectively, so you should be OK.
Oh, and JB are members of the credit services association. Any funny business - report them.

Write to them telling them you acknowledge no debt to them and ask for a signed credit agreement. You need to send a £1 postal order and by law they have to reply to you.
