Underpaid Tax Can anyone help?

Got a letter this morning from HMRC advising me that I had infact underpaid tax in the years 08/09 and 09/10 which amounted to £1662

They have said they would collect this in tax year 11/12

I was made BR in August of this year

Anyone know if I can retrospectively include this underpayment in my BR as the debt was incurred prior to it? (albeit I did not know this untill this morning)

Should I call HMRC and tell them to cease and disist from collecting the debt or should I ask the trustee of my BR write them a letter advising them this debt is included in a BR petition(If they will do this)

any help on this matter gratefully received

Lotty

If it is just income tax (rather than say tax credits) then it should be bankrutcy debt and so you should not need to pay it, i would write back to HMRC tell them abut the bankruptcy and that you beleive it is included

similar thing happened to us when employer took wrong amount of tax from expences. We just told them it wasn't payable and they sorted it out.

Hi DI It was normal income tax I was on the wrong tax code (unbenownst to me) and they have sent me a demand for £1662 to be paid in the tax year 11/12 I really can't afford to pay it back at £138 per month. My SOA is tight enough as it is.

I am frustrated because the demand arrived this morning and the OR and HMRC are shut Also very worried about the amount and the fact I am BR and afraid I am breaking the law by being in debt.

I will write to HMRC on Monday and also ask my Trustee to write to them advising I am a bankrupt and not liable for any unpaid income tax prior to my petition.

    Thanks for the reassurance

You aren't breaking the law at all, no matter how much it is.

It is just another pre-existing bankruptcy debt that can be included now you know about it.

Thanks everyone This forum is fabby when you get an unexpected letter and your mind goes into overdrive with worry.

I think after all the months of stress, phone calls and letters then you are BR and most of the hassle is taken from you.

Just shows how underneath the calm exterior I now seem to have I am still the same. The slightest knock puts me back on red alert.

I wonder if I will ever feel normal again???

You guys out there manning the watch enable me to carry on

    Thanks
