Back here after a year and some progress but have now hit a sticking point and would welcome advice ...
Finally got a very old assessment (involved MP) recalculated in June this year - it refers to 1999. PWC then applied for a departure against it (she has one in place against the current assessment). At first CSA said No but then changed their mind and quote Reg 46 Child Support Departure Direction and Consequential Amendments Regs 1996. Am trying to argue that this is wrong because the review of the 1999 MA has no impact on the one that's currently in place. To add insult CSA have also applied departure to assessments made later in 2004 even though PWC applied late for these at the time and so was only awarded departure from 2005.
Is anyone familiar enough with these Regs to offer advice? CSA Departure team say to definately appeal as they haven't had a case like this but won't change their decision.
