So it may already be statute barred. Can you remember or find out exactly when you last paid or acknowledged it in writing?

oh really? i thought it was from the date you defaulted? (i'm new to all this!)

I don't have any paperwork relating to the original agreement, but i know i haven't paid anything since before 2005. would sending the letter Gordon Hose linked me to on the previous page provide this info?

I'm not an expert on this but if I read correctly by sending a letter requesting details to confirm enforceability you would be acknowledging the debt, at that point the Statute Barred option becomes a non starter?

don't send any letters for now

I think you are confusing 2 things: default mark on your credit file and SB. Default mark is only a mark on marketing tool called credit file. It will not be visible to the financial world after 6 years (but it still will be there). SB is counted from the date you last confirmed the debt - you did it in 2004, then by the end of this year it will become SB. If they will chase you for it in 2011 or later then you will send them SB letter. You have to do this as they can still go to the court if you don't defend yourself and do not say them it is SB barred. But for now, sit tight (I would, anyway).

    Sounds good advice.

If the last payment was made before 1 Nov 2004, then it's stat barred already.

But I would give it a few months as Wrinkes, Jadex etc suggest
