work related stress

hi

i have been signed off work for 2 wks today with work related stress.

even after the two weeks i cannot see myself going back there.

if i was to give my 4 wks notice to quit - what salary would i receive.

under my contract i am entitled to 13 weeks full pay in a 52 wk rolling period.

would i still receive this - or would they drop it to ssp.

    Depends partly what your contract says, I think. ACAS would be good people to advise you. If you are owed any holiday pay, you would definitely be entitled to that, but I am not sure if an employer is obliged to pay you for your full notice period if you are signed off sick when you give notice.

    If you find out before anyone else tells us, please let us know!

    Why dont you see if your doc can sign you off for a little longer then you may find you might want to go back after a lnger break, if not it will give you a little time to find another job xx

    They should pay you for the first 13 weeks you are off, then after that you would probably receive SSP. Don't hand in your notice as you may not be entitled to any money. If its work related stress its not your fault, see what your company has to offer.

    Don't forget its 13 weeks in a 52 week rolling period so if you have had sick leave in the last 52 weeks that counts towards your 13 weeks. If your contract doesn't make separate provision for sick payments in the notice period separately, then you would be entitled to full pay during that time.

    Is this 13 weeks sick? If so I would guess once you terminate your contract you will not be entitled.

    I knew after being off sick for a few days I would not be going back for same reason as you, I waited until my SSP was finsished (28 weeks ) then once I was safely onto Incapacity Benefit handed in my notice. Even if you are not going back be careful what you do as if you leave and go onto IB before you are 28 weeks sick the amount is less than 60.00 per week. Have a good read at your contract.
    TOTAL 44 weeks lose. 6st 9.5lb :T

    After 2 weeks I would not make any major decisions. If you have 13 weeks pay give yourself some time.

    If its work related stress I would be communicating the problem with your manager (if you have not already done so) legaly they need to take it seriously and look at stress caused by work but can't be expected to do something about it if they don't know what it is. Give them a chance to sort it. If it does not help you could then hand in your notice and look at taking action regading constructive dismisal.
