Can you please give me your opinions on my letter. Its all ready to go I just wanted to know if I have put anything in it that is wrong.
Dear Sirs,
Further to your letter of 6 September 2010, we are writing to inform you that due to exceptional financial pressures have declared ourselves bankrupt and cannot afford the mortgage payments and upkeep of the property at 3 J****** C****, R******, **** ***. Please accept this letter as confirmation that we wish to voluntarily surrender the keys to the property detailed above to yourselves so that you may repossess the house as you require.
We are surrendering the keys to you for and confirm that all keys have been provided and that the property is vacant. Should there be any contents remaining, these will be disposed of by you.
We do not object to any repossession action through the courts.
We believe the mortgage outstanding to you is currently in the region of £120,000. For your information, the last valuation of the property made was for £116,000, this was made in March by the Official Receiver. In the event of a shortfall, the shortfall liability will not fall to us as this will then form part of our bankruptcy. The Official Receiver has been informed of our intention to allow repossession.
The property is left in good condition. We have informed the local council that we have left the property empty therefore it is exempt from council tax for 6 months. Following this time period it is exempt without time limit as the dwelling is in the possession of the lender. We should also inform you that we no longer hold any buildings or contents insurance on the property.
Thank you for your assistance; we shall have no further contact with you regarding this situation. Please direct all further correspondence to the Official Receiver’s office, at the address below.
