Had a hearing for an Order of Sale on the house that I share with my new partner. She put in all the money from the sale of her home and the CSA said that as it is in joint name then they want to sell it to take the arrears that have been found to have been run up by their own fault! They have paid out compensation for this after 2 ICE reports, there is a 3rd on going at this time. and an Ombudsman report as well!
She was a little put out by the attitude of the CSA on this point and put in an application to the Court to protect her money, if this is granted, then the CSA will get nothing from a sale of the house!
The CSA came along with a Section 8 application and an aggressive Barrister. Outside of the Court he had a go at me, if it made him feel better then it achieved something anyway, he left that so angrier that when we went in to Court he was still upset! He then went for the Judge, such a bad move on his part!!!!!!! The Judge asked him a few questions and he handed the Judge a pile of paper and tole him that this was all of the Orders! The Judge looked at them and then asked for the rest of them, opus, it was then the turn of the Judge and he gave him the benefit of his experience. You have to hand it to the guy though he then came back at the Judge again, by now said Judge and his sense of humor were starting to part company!
He then ask my partner some questions, and then when he had enough information, he started!!!!!! The application from the CSA has been joined to my partners application but has priority and as such will be heard first! If it is successful, as from what he said it probably will be, we will have to see just what the CSA then decide to do!
But the best is the last, he told them that their application was now the wrong one and to go away and do it properly. The case as it stood was effectively thrown out as it was wrong!!! But as we all know the CSA don't make unforced errors, do they:rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl:!!!

She is now taking me to Court and is very nervous about this, she calmed up when they started to talk to her, and she will be under cross examination as well. The principal is very simple but as the Judge informed the Barrister it is in the rules of the Court it is the agreement or understanding that we had between us when we got the house that counts. It would appear that it has not got to be in writing!
The down side is that the application for arrest warrants went out when the Judge binned the case, so will have to try again as they say. They also know that we are asking for compensation to be set by the Court for the health and stress problems that have nearly led to the death of my partner by her own hand, and may yet still. This is a figure in to the tens of thousands of pounds and based on a potential 'Death in Service' benefit from her work, and they don't like that at all. I can see this case costing the gov a fortune as we will both be on legal aid and they will if she is successful and this has been hinted at by the Judge get nothing, complete insanity , but it is the CSA, and we as tax payers will pick up the bill.0 -

Hahaha @ speedster...and Well Done Blob...but WHAT a crock of s**t to have to put you both ( you and your lady) through..Reading through some of the recent posts I can see ALOT of people gaining more money from the government in compensation than the CSA gaining..providing they DON'T give up their fights...
I cannot believe how useless they REALLY are at looking at the reality of their own mistakes..some of which could be sorted out SO simply....Its simply beyond idiocy...
Good Luck with ALL you fight...you inspire those of us who are not (as yet) at the point where you are..and it is always good ( for us, albeit not for you ( Sorry..:( ) to have someones lead to follow..
