CSA re-assessment

in Need of some advice!

My husband and I have contacted the csa to have our case looked at again as our income has reduced since the claim was first made. We pay for his son from a previous relationship and we have 6 children living with us. (4 from my previous marriage and 2 we have had together since).
When the claim was first made we were in receipt of working tax credit where as now we only recieve child tax credit. On top of that my husband has had a 5% pay cut. We do have some debt so as i was looking at our budget, thought we would phone the csa to have the case reviewed. It now seems that child tax credit will still be taken into consideration even though the childs mother claims it for herself. This seems unfair as well as they only allow 25% off the earnings for 4 or more children and yet 15% for the child who the claim is for. when the claim was first made we only had 1 child together then we had another a year later. I now fear they will up our payments greatly which is going to be a real problem. My OH has always paid for his child and of course will continue to do so ( he even paid for her other child for many years but when we got together i ended up paying her her money because he could never afford it. as a result of that I stopped paying for the other child to which she took offence and hence went to the csa who upped her payments) . He stays with us at least 1 a week sometimes twice but she disputes that and so we need to have proof, how can we prove how often he stays?

Before anyone thinks we are purely trying to reduce the payments for him that simply isn't the case. and if it goes up then so be it, however i predict our budget will decrease even further over the next year as my eldest leaves school. It simply is trying to budget better and to pay what is in line with what it should be. His ex also claims income support, housing benefit etc and according to the csa website the benefits they receive also are taken into account is this true?

We have also had to start paying a car allowance through wages,as he needed a suitable car for work but we couldn't afford it so he had to take that option. Does that get taken into consideration when looking at the net Pay?

really confused and worried and don't want to come accross as tight but I also have my own children to worry about and it the system seems very unfair sometimes and to be honest biased.

    In fairness, folk start to judge when all sorts of unecessary information is added to the post, which can then be used as amuminition.
    Anyways, yes if the income has dropped for whatever reason and likely to remain so, then he can seek a re-assesment based on his current circumstances
  • no please don't get me wrong, I see both sides of this as I also have kids from a previous relationship and also have had maintenence issues etc, but the NRP shouldn't always be judged wrongly. I was just hoping someone could clear some of the issues up as the CSA just don't seem to want to answers any questions as facts just that "we may take that into account, we may not". It can be very frustrating.

    I have recently requested a reassesment as my income (self employed) has fallen by 10% their reply was because my income had not fallen enough they would not be changing the amount I pay :(

    I thought the difference was 5% or £5 per week, bet if your salary had gone up 9% they would be on your case :eek:

    I will double check if i can through my dp files. If you are classed as self employed i think the tolerence level is a measily £1 per week so they should reasses you (they did in my case)
