Correcting credit reference entries

I am in need of URGENT advise please! I am hoping I have posted this in the right place.

Although my husband and I have a large amount of debt, all of which we have defaulted on, we do not have any CCJ/Bankruptcy debts. We are in the process of being referenced for a new privately rented home. Today we were called by the letting agent to say that although I have passed the credit check (with almost twice the defaulted sums my husband has) he has failed outright, without the opportunity to have a guarantor or pay rent upfront. The agent says this is almost always due to CCJ or Bankruptcy on our credit file and to contact Callcredit to see what the problem is.

On looking at Callcredit's file on my husband, there are 6 defaulted CCJs from someone with the same name and DOB as my husband. The information is held under the linked addresses for this individual in Aylesbury. We have never lived in or near Aylesbury and this person has a middle name where my husband doesn't. There is also this persons spouse as an associate on my husbands file, although he has never been married before.

I am in deparate need of advice quickly as our current tenancy agreement runs out in less than a month and I am due another baby in early December. We need to move ASAP and everyone seems to say we have to wait 28 (working) days for anything to be done. My husband works abroad two weeks at a time, and callcredit were incredibly unhelpful saying he would have to put his complaint in writing and get his 40ft trailer (he's an HGV driver) into a foreign high street to find a post office!!
He appears to be on two electoral rolls at the same time, and callcredit even have my husband on our current electoral roll with a middle name!! This is simply incorrect and our local council would not put a middle anem where I have not supplied one, so Callcredit are supplying blatently incorrect information to those viewing our credit reference.

What evidence can we provide to say he is not this person? A birth cert shows name and DOB which doesn't help, current address info doesn't help.

We seem to be totally stuck. When I called Lowell financial (one of the defaulting debts for this other person) they said they don't even provide info to Callcredit, and don't have the account linked to our address anymore.

Please please does anyone know how we can sort this out quickly so we can find somewhere to live!! I do not fancy being out on the street 9months pregnant with two other children, which looks more and more likely!!:(:(

You should put the complaint to them in writing. If they have incorrect details on your husband's credit file, then they are in breach of the Data Protection Act. You need to allow them the chance to rectify this before making an official complaint though.

I would also check equifax and experian to make sure their records do not have the same errors. I believe you can still check these two online for free (if you cancel within 30 days).

  • Can you not re-negotiate your tenancy Agreement?

Also to add - you can put a notice of correction on your credit files that have this error. This is a note to say that this person is not associated with you financially and should result in a manual chack being done rather than an automated one which will probably decline you again.
