minimum holidays to be taken every year

sorry i wasnt clear. Situation is that i have lots of holidays this year left while OH doesnt have any. We get next year's entitement in christmas. I am not saying i dont want to take holidays. what i want to do is to carry forward holidays into next year(as per company policy we can carry forward maximum 15 days into next year as long as we have taken minimum required leave for this year).
Question is surrounding this minimum required leave. my employer says it is 148 hours plus bank holiday. while i think it is 96 hours plus bank holidays. So its about these 52 hours which i want to carry forward into next year.
Also this 148 hours doesnt make sense. If we have to take 28 days off, including 8 public holidays, then it should be 160 hours (20 X 8) and not 148..
Also just a thought.. does paid sick leave count towards meeting this minimum requirement..

OK - that is clearer.
You have to take 20 days. Full stop. Your employer may allow you to carry over - but they do not have to allow it. Your contract may state that this is allowed at the employers discretion (this is the normal wording) - and if so then you have no right to carry over if they refuse. It is a case of use it or loose it. If the contract states that you are absolutely allowed to carry over (no discretion involved) then you ought to be allowed it - but there is no legal right to enforce this because the employer does have the legal right to insist it is taken and can tell you when you must take it if you refuse.
As for the number of hours - are you including unpaid breaks in the 8 hours? But if you think the leave is wrong - ask the employer to explain how it has been calculated.0 -

its actually 224 hrs as an employer is under no obligation to pay extra for bank holidays or let employees have the day off. as long as there is the oppertunity to have the statatuary 28 days then this is enough. as has already been said "use em or lose em"Be Alert..........Britain needs lerts.0 -

Sick leave is not paid leave in terms of the Working Time regulations so it cannot count towards meeting the minimum paid holiday entitlement.0
