ok maybe i am being a bit nieve here, but i have ordered them, got the email confirmation and also have it as an outstanding order in my account details....

how exactly can they get out of this? it is not my fault they had a glitch? could i threaten legal action if they do not go through with the transaction? surley they are legally bound to this!

Usually these online companies have a clause in their terms and conditions that state that there isn't a legally bound contract until goods are shipped, which is usually the point at which they also take the cash. Up until that point they can easily get out of it. It all depends upon how much on the ball they are and how fast their shipping / payment processes are.

i have looked in the help section, there appears to be no such clause in there?

infact after spending 10minutes looking i cant find anything other then things that confirm that we WILL get these sentences such as

"If an item is out of stock when you place your order, it will automatically be entered into our purchase ordering system. Our purchasing team process orders on a daily basis and items are normally received within 2-5 working days from our suppliers."

EDIT : this have just added this sentence to there terms and conditions

"However, some items may not be received within this time frame due to stock availability issues or items being withdrawn or deleted by the distributor. Should this occur, we will endevour to update you as soon as possible."

i refreshed and it appeared....looks like they are planning to delete the orders then, i expect a nice fluffy e-mail shortly, dont know about everyone else but i will be calling them to complain

It won't necessarily be in the help section. Usually on online stores when you place an order there is a tick box, or section that lists the Ts&Cs that you are accepting.

You need to look for information about what happens when a mis-price is noticed, or where a legally binding contract is formed. For example, with amazon there is no legally binding contract until the product has physically been shipped.

Even if there isn't any obvious Ts&Cs any court would not accept that there is a legally binding contract unless money has been taken. And even if it has then many mis-prices fail.

  • Just had this sent to me

CANCELLED - Not available from distributor
After repeated attempts we have been unable to source this item and have been advised by the distributor the item is not available. Your order has been automatically cancelled, and you have not been charged.

Funny how they can get it if you order at full price!!!

Come on, you know it was a mistake!
Anyway, there's no contract until they have taken your money.
    Can I help?
