Why Oh Why do they persist!!!!
I have told them 3 times now that we are Bankrupt and every time they call they tell me thay are allowed to call for each debt.
I thought once they have been informed as a company that I am Bankrupt they were not allowed to contact you but the IDIOT told me that It would be easier to pay the debts and that is the only sure fire way to stop them calling.
My reply to that was, do you realise you have just asked me to break the law as I was told by my OR that I am not allowed to pay anyone who I owed money to before bankruptcy.
He then said, Can I have your bankruptcy details and I said not until you give me your name. He would not give me his name so I told him that he better make sure that Westcott never contact me again and I am going to report them to the OR and tell them everything he had just said to me and they will probally prosicute him for that. I gave hime the details for the 3rd time and I also told him that the call had been recorded and the phone promptly went dead. lol......
I didnt record the call but he dosent know that I hop he cant sleep for a few nights and then he may know what some of us have been through.
If they call again i think i will just say OK hold on for 1 minute whilst i get my credit card and then just leave the phone hanging until they hang up PMSL.....

You can send them the "dont call me by phone" letter, have a look on the debt free board.
They are wrong, they're not allowed to call and bother you all the time."We want the finest wines available to humanity, we want them here, and we want them now!"0 -
I could do with that for my wife but I can't find it. Could someone in the know post a link? You can send them the "dont call me by phone" letter, have a look on the debt free board.“Procrastination is my middle name....well it would be if I could be ar**d to contact Deed Poll."0 -
Try sending them this letter compiled by the lovely Fermi. Obviously adjust as necessary and send it signed for.
Quote:Your Address
Date:
Creditor's Name
Address.NOTICE: Pursuit of a debt included in a bankruptcy. Do not ignore this letter. You must cease collection activity IMMEDIATELY.
Dear Sir/Madam
Account No: *****************
You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.
I would point out that the account was included in my bankruptcy which commenced on <date>.
Consequently, the debt in question is no longer my legal responsibility.
ALL contacts and claims regarding the debt MUST be addressed to the Official Receiver's Office dealing with the case.
My case was XXX of 200X, at <somewhere> County Court, and the address of the Official Receiver is below.
<Address of the OR.>
A copy of the bankruptcy order is enclosed for your convenience.
Please note that the Official Receiver has requested that all future contact from your company regarding these accounts is reported and forwarded to themselves, and that continued contact with myself may result in Official Receiver taking enforcement actions against your organisation.
Please also note that we are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when the debt is not due.
In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
In addition, your continued telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.
This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
We await your written confirmation that this matter is now closed.
We look forward to your reply.
Yours faithfully

Just got another letter from Wescott but after this mornings Halifax nightmare and the subsequent call to the OR I think I am just going to let them keep wasting thier money calling and sending letters they can send someone round if they like I will offer them some Freshly Brewed Coffee (mmmm) and I have some nice choccy biscuits (rich teas for them) as I know they will be charging the DC's lots of money, after all it all benifits the royal mail and the telephone companys which all only boosts the economy lol...0

Sorry to hear of your troubles.
I'm just wondering how commonly this happens to people (being chased by debt collection agencies after bankruptcy), because one of the reasons I've finally decided to become bankrupt is that some agencies persist in contacting an address I used to live at 8 years ago. A vulnerable family member now lives there and I was hoping that my going bankrupt would put an end to any such contact. Am I wrong?0 -

once all my creditors were informed the calls and hassle stopped. i think most do stop, the odd ones continue.
if you receive unwanted phone calls you could change your number but it hopefully wouldn't come to that. if a creditor persists normally you can tell the OR and they will give them a 'friendly reminder'0 -
Some creditors take a very long time to get the message and will continue to write/phone after bankruptcy.
Send any letters to your trustee/OR/AiB to deal with, tell them your bankruptcy details and then hang up if they phone – apart from the extreme annoyance and irritation (especially if they phone you at work), there’s nothing more they can legally do once you’re bankrupt.
They will eventually realise that they’re wasting their time.0
