Statute Barred debt

Hi all,

Please can someone help. I have 2 accounts on my credit file which are now statute barred as I have not made payment or been in contact with the creditor for well over 7 years. The original default with the original creditors were back in 2002 and the DCA keeps updating my credit file with a default on the account on a regular basis

The debt on the credit file states that they are owed to Aktiv Capital, but recent letters have come from Philips Debt Recovery. I wrote to Philips with a staute barred letter for this debt and I have received no more letters from them in the past 6 weeks, so they must have took notice of the letters.

What I want to do is write to Aktiv Capital who now own this debt to contest the validity of these debts and have them removed from my credit file, but the last letter I received from them was in 2008.

Does anyone have a letter template I can use to write to Aktiv Capital, asking them to prove the validity of this debt and have the debt removed from my credit file. I don't have a recent reference number from Aktiv Capital so what should I do? Use the reference number from an old letter in 2008, or do not include a reference number? My worry is that 2008 is close to the 6 year period and I don't want to shoot myself in the foot if I accidntaly triggering off another 6 years if I acknowledge this reference number?

Also, does anyone have a letter template to write to my CRA to inform them that these debts are statute barred as the original default was over 7 years ago and that I am contesting the debts with the DCA.

Any help will be much appreciated.

    Don't worry, you wouldn't. If the debt is statute barred now, nothing you can now do will start the 6 years off again.

    You say the original default was 6 years ago?

    What is the "default date" listed on the CRAs now? Not the "file last updated date", but the "default date".

    The entries shouldn't even be on your credit report now.
