Last chance saloon

I have really got myself into a bad situation and now I need to know the best way out of this.

I have avoided paying my debts for nearly 10 years and during this time I managed to get an attachment to earnings order. I paid this for a few months until I lost my job. I did not contact them to let them know what was going on.

Now I have just got a new role and had a long hard think about my debts / future etc. I think that I am going to apply for Bankruptcy - however I am so broke that I don't know if I can afford the fee - is there anyway to get this waived. I can't see a way to do this without being on Jobseekers.

I am now on 20K per annum - this is a 8K reduction from my previos salary. Basically I need to do something now but I don't know where to start - any advice anyone??

    Here is my SOA

    I havent put in any monthly payments as I am not making any at at the moment.

    I am paying a one off payment to my landlord that covers all bills etc.

    The fee is £600, the only part that could possibly be waived is the court fee of £150, everyone has to pay the other fee of £450.

  • Hi Yockers - Welcome to the forums :)
    I myself took advice from Citizens Advice and my financial advisor there helped me every step of the way for my B/R. He even told me I could apply to local trusts for assistance with B/R Fees. I was awarded full costs for my B/R from United Utilities, however this can only be claimed by C.A.B on your behalf, you can't claim from the funds yourself. I was so dire that I didn't know where or who to turn to. This site has helped me and many many others facing Bankruptcy and more knowlegable people will soon be here to assist you. Good luck and I hope you get the help I did.

    Thanks - I need to get this sorted and I am desperate to - I think that Bankruptcy is the only way now - which is fine. I just need some help...How did you get in touch with CAB - can you make an appointment or do you just turn up??

    Each Area is different so you are best phoning up as you might need a specialist debt counsellor

  • I turned up and was told to make an appointment, which I did there and then. But my appointment was a couple of weeks wait, due to them being very busy. May be longer nowadays! However I was given a letter stating I was waiting for an appointment (for me to prove I was dealing with my debts - to pass to anyone who was hassling me at the time) When I finally got to see my advisor we sat down for a couple of hours and sorted through everything and he explained everything to me. I asked a lot of questions and then he applied for a grant to assist with my B/R fees, which was granted. It was a long hard decision for me to reach but with the help I received from C.A.B and from the people on here I am glad I did it. I am now discharged after 12 months,and now can see a better future for mysef :) Hope this helps

    Oh another thing I forgot to say...Be totally honest all the way, don't lie about anything. I was petrified about my debts and having to explain them was embarrassing, but I told them everything they wanted to know. Even when I had the phone call from the O/R. The people on here advised me on my income/outgoing sheet. I was amazed what I could claim as expenses, things I didn't even think would be allowed.
    Use this site and use other peoples advise and you will be ok. I wish I had found this site a lot earlier than I did.

    You state that you avoided paying debts for ten years - if that's the case, and as long as you have not acknowledged or paid the debt in that time then the debt will be statute barred and they cannot legally enforce it (6 years in England & Wales).

    There are a few exceptions, and I'm not sure if the attachment of earnings would fall into this though.
