Bankrupt and stressed out with OR

Take it that the OR is more right than the CAB! The OR will have legal guidelines to adhere to so although to the CAB, us and you that spending extra on a poorly dog is acceptable, the OR cannot make that allowance if its over the guidelines. They have to be seen to be fair to everyone.
As to reducing the IPA, re-read my posts about the ORs voluntary comment. There is reason he mentioned voluntary so check this out first as you may never have to pay anything, let alone reducing one or mentioning an IPO.0 -
hey Kepar. Why would i be on your case? I have never ever posted about ipo/ipas so please dont bring me into this one again.

Actually Kepar, and i dont want to argue, but your post makes it sound like im against ipo/ipa and thats not true so could you please amend that post. We actually disagreed on something entirely different. Thanks x0

I completed the SOA with a CAB lady, she was telling me there were limits to things I could spend on and moved costs around around etc and said I was unde the threshold for having to pay an IPA. BUT the OR said I being unrealistic with my costs and reduced them... so who is wrong? the CAB or OR? I have asked for a copy of her list of my SOA to see whats different and if there is something missing or that has been significantly changed I will try and dispute it. All my dog costs are included but she said I was spending too much despite the CAB saying I was within reason. Someone's ballsed up somewhere!
Anyhow she said it takes a couple of months for the IPA to be put into place so I am going to try and dispute it if her version of my SOA is unreasonable, see if I can reduce the IPA payment and if not let her make an application for an IPO!
This should take me past Christmas hopefully and I can relax knowing I can at least go to the pub with my family for a bottle of wine!
it is possible that the OR has made a mistake with her IPA calculation, but you're right you won't know that until you see a copy of it.
The way I look at the IPA is, its a lot less than I was scrabbling around trying to find every month for minimum debt repayments before I went BR!0 -
dancingfairy wrote: »Kepar I totally disagree with you - I personally didn't read the OP's post as 'trying to get away with' not paying an IPA - I agree that people aren't exactly going to be jumping up and down at the thought but at the same time it seems reasonable to me for the OP to see what the OR's basing their figures on and to reach an understanding with the OR. The OP is obviously highly stressed with everything at the moment.
And as to your comment that the OP is better off now they are bankrupt and had 20000 written off - that's really judgemental. People don't suddenly put years of trauma behind them.
Perhaps a bit more compassion would be helpful?

thank you dancing fairy for your support. I can confirm that I had 14.5k written off. It could have been over 20k but I got a 6k pay out 4 years ago and paid some debt off. I dont see that as 'trying to get away with it' and I havent said I was better off before because I wasnt! I am currently homeless and jumping from one accommodation to another.. why? because my reltionship broke down due to us not being able to have children. Am I asking for sympathy? NO! I am saying that I have had a lot on my plate; as EVERYONE HAS, and this is how I am dealing with my BR after years and years of debt and ALOT of other personal stress in my life.
Its people like yourself that think your worse off than others and feel the need to gripe at us that make me sigh in disappointment. Whether its 74 quid or 400 quid IPA a month; the fact is we have all had to go BR for whatever reason and that is stressfull enough as it is.
I dont understand the process and have mentioned I struggle with figures so here I am sounding off asking for advice. Is there anything wrong with that?
I have actually received the OR breakdown of my SOA. It seems the
CAB have allowed me to over estimate on the housekeeping (although it is an actual outgoing) my £50. So CAB have made the mistake, not me or the OR. But without CAB I wouldnt have been able to fill in the SOA and wouldnt have known what 'housekeeping' was as there is no guidance on the SOA if doing the form alone.
Anyhow... I am grateful that I have no debt but not grateful that I am still in the same situation, no disposable income (as surplus will need to be used to make up for the disallowed items) and still no life... so thats 'my way of life'.. ace isnt it! and I am sure there are lots more people out that in the same boat.
kepar thanks for the support :T0 -
Just a couple of really important points that don't appear to have been stessed yet for the OP.
You ARE NOT ALLOWED to pay your family debts back with your disposable income. This can land you with a bankruptcy order for longer. I understand the moral obligation but you must hide this fact from EVERYONE if you do it. Don't pay by cheque or bank transfer. It is classed as favouring a creditor and is against the law.
Also, if you refuse the IPA, the OR will get an IPO (order) and it could be for mroe money. so keep calm, negotiate and count it in your head as a "loan" with a fixed end date. This will help you to get through psychologically.
Baby steps are best, first go BR, have interview, agree IPO, count the months down and get discharged.
best of luck

I got the breakdown through today and its set out differently to the soa on the br form so I cant make end or tail of it. Plus the or has changed it somewhere since our call because the ipa amount is now 69 not 74. I need to look at it as above. Its less than what I was paying. I am now free from a 3rd of the debt and its for only 3 years rather than about 110
