    Thanks for your update,
    Sorry you have lost your mum. I havent lost a child or a husband and I really think that losing my mum has been the very worst thing that has happened to me in my life, and that was 28 years ago.

    Good luck and hope its sorted soon.

    If probate is not required.

    Is there a public place where will's are published etc. for public viewing?

    If not how can a will be contested and seen to be being carried out, when probate is not required?

    What responsibilities do executors have to keep copies of a will and for how long?


    A bit late to reply but:

    if probate is not required then the will is not public

    with difficulty, if at all

    they should keep the will for 12 years whether probated or not.
  • On contesting, my understanding is that if (say) everything was left to new husband, then any children could only dream of winning any such case to the extent that they can prove they were financially dependant upon the deceased. For most adults, this tends to be a non-starter. Anything like "I know my mother wanted or said she was leaving X to person Y...." is a non-starter.

    Thanks for the post McKneff, it was not my mum thankfully she is still around and loving as usual. It was my partners mum and she is still in a bad way, brave face sad heart.

    As it stands now we are not contesting the will, but other family members are looking too some how, but I think my partner is happier knowing that at least the Will be read as per the mothers wises than ignored or hidden away..
    Arhhhhhhh, If only Life was that simlpe!!

    Anyone can contest a will - but it's going to cost them money (£400 up front in court fees I believe plus solicitor's costs) and is down the drain if they have no valid reason.

    Note the law in Scotland is different - family does have the right to a share of certain property.

    Have you got a copy of the will from the solicitors so you know what the wishes are and who the executors are

    I lost both my parent in the last 12 months(Dad just on a year) so I know how she feels .

    It will take time, even when you know it is coming and have time to prepare, inside you think your parents are going to live forever.
