Hi,
This is my first post although I have been using this forum to gather advice for a while, could anyone help me with my repo letter. I am going br in 2 weeks, haven't paid the mortgage in 4 months to gather br money and rental deposit, move into rental property on sat. I have got court letter from mortgage company to take possesion on 1st dec but I want to send the keys back before that to tick another job off the list, does this letter sound ok or am I waffleing on to much!?
Thanks

After taking advice from the CCCS Please accept this letter as confirmation that I wish to voluntarily surrender the keys to the property detailed above to yourselves so that you may repossess the house as you require.
I am about to be declared bankrupt and have now left the property. As a result of my bankruptcy, I shall no longer be contributing any further payments towards the mortgage and henceforth, I would advise that you cease any further payment requests to me. To make you aware, myself and Mr ***** were separated in Aug 2008, since this time he has made no contributions to the mortgage or property. I have had no contact with him for 18 months and do not have a phone number or forwarding address to give you.
As the first charge on the property, I am surrendering the keys to you for voluntary repossession. I confirm that all keys have been provided and that the property is vacant. Should there be any contents remaining, these will be disposed of by you.
I believe the mortgage outstanding to you is currently in the region of £182,000.
For your information, the last valuation of the property made last year was for £190,000.
I should add that in the event of a shortfall, the shortfall liability will not fall to me as this will then form part of my bankruptcy.
Lastly, I should also mention that a second and third charge also exists on the property, one in my name and one in Mr ****. The Official Receiver should be in contact with you shortly to discuss mine further.
I would like to thank you for your assistance in this matter and also for your help over the past few years. I naturally regret the course of action detailed above which sadly has become a necessary route to take.
Yours Faithfully
