Advice - MP3 Player - £0.00

A little while ago there was a code posted which if you bought another item on the electronic puchase machine sometimes came up as £0.00. I tried this in a local store, Bought some earphones for £1.99, entered the code in for the MP3 player ( advertised as FOR SALE and 3 available ) entered the add items to my basket. It then said to put in my debit card and give me a receipt for the 1 pair of earphones and 1 MP3 player with a total price of £1.99 - then the usual wait to collect etc.

Went to the counter and assistant and manager said I could not have the MP3 player, even though a had a receipt and the products said sold.

I thought if the product was shown as for sale ( an offer ) and I paid an amount of money ( acceptance ) even though the MP3 Player showed up as £0.00 but for sale and with a receipt to say 2 goods sold etc then Argos should supply the goods.

The manager said the goods were a "free gift" and was not prepared to give me it ?

I think I understand that if they did not accept my payment, then they could refuse to provide the goods, but he wrote on my recipt - NOT given

Should I pursue ?

  • ok, let's break down what you're saying:
    1. A product being shown as for sale is not an offer!! (Think of it this way; if you sell a car in the paper and 8 people give you money for it, are you to sell them all the same car at the same price). A product being shown for sale is merely an invitation to treat (i.e an offer to make them an offer)
    2. In order for a contract to be formed they must accept the amount that you offer. As you used a quick pay kiosk and the amount was 0. I seriously doubt you would get anywhere by pursuing this.
    3. The mp3 player isn't actually advertised anywhere as being for sale, it is merely on the system to enable them to keep track of the stock.

    But I'm sure some people on here would advise you to stand your ground and fight them all the way. However, is it really worth it for an outdated mp3 player?

    At the managers discretion you were refused an item, I wouldn't waste your time pursuing, they always win!

  • There is no contract until the goods are handed over, the manager didn't give you the item then take it off you so you cannot pursue this as the contract was not completed. If you did pursue he would quite rightly point out that you were trying to swindle the company as you were trying to get a product that was supposed to be free as part of a bundle offer without actually buying the other item in the bundle. If anything you would only get yourself into more trouble not get yourself a free MP3 player. I would count yourself lucky and not try to defraud any other comanies in the near future.

    Whilst I would agree with most of your statement the emboldened text is inaccurate in that the contract was formed once the payment had been exchanged, the fact that the op did not have the goods in their hands is of no consequence the title of ownership had already changed hands at that time.
    Otherwise yes an attempt to obtain goods by deception has occurred.

    ive had similar thing happen to me, (with diferent item tho). it was a mobile that i had reserved online at home. went to store to pay, they said they cannot give the phone for the reserved price....

    ... i did fight it, got a load of jargon saying 'its not a binding contract' etc etc..

    now when you book online there is a diclaimer saying something to this effect...

    i think you will be waiting your time... argos dont care about the custom as they are the only catalogue shop as such (esp after buying Index).. so they know customers DO RETURN TO THEM...

    its a Shame!

    TESCO will be doing something similar to Argos (ie online catalogue) and have their own del vans for this .... might show some competitive prices?

    (EVEN STILL A SHAME that its tesco... I dont like to see them get any bigger than they are already... wish it had been other smaller retailers .. )

    off the subject, Tesco make a PROFIT ... that means the money that ends up in the their pocket.. of £27000 PER DAY

    best not tell the african farmers who are paid a pittance in return !!!!!

    Its because of the amount of !!!! ups Argos makes. Lets face it if they cant get a catalogue right that needs months of planning, how the hell can they get a website right that is changing all the time ;)

    Stores are also authorised to allow you to purchase items at the reserved price as long as you can prove it. Management descression tho. As i always say if you go in with an attitude you will get nowhere!

    You tried to obtain goods by deception, N.B. a criminal offence

    the only thing you'll be pursuing is potential trouble for yourself
