Redundancy Bonus and IPA

Hi there,

I hope you can give me some advice.

I was discharged in Dec 09 and had a 36 month IPA to pay every month of which i'm about halfway through. I was made redundant end of Sept (getting statutory redundancy just over1k and severance pay of 3k) and I managed to find a new job that started 2nd week of Oct. Unfortunately with the new job i'll be around £180 short in net pay every month.

I decided to write a letter to the RTLU to say that my circumstances have changed and that my IPA needs to be amended as i will be now earning less money. They have now responded with a letter asking for documentation with my redundancy breakdown and a form asking for my updated expenditure figures.

Now i'm a little worried that they may want to take some of my redundancy pay - I'm very stressed about this as i've already paid for a few things that i've needed such as car repairs £900, dentist £300 and clothes for new job £200...

My questions are as follows: i've read that maybe they can't take my statutory pay but what about the severance pay? If so would it be a % or the whole lot? Maybe the fact i had a week of being unemployed would allow them to let me keep some of it...and how would they react now i've spent some of it?

Secondly, is the P45 good enough documentation?

    As redundancy after discharge they should have no interest - I suspect they want copies of the documents to confirm dates, etc.

    they will ask you to fill in a new SOA and they may stop your IPA

    Sadly incorrect. As you have an IPA set up everything involving money is fair game. They may want to take some of it off you - it'll count as a windfall, especially as you already have another job. Fingers crossed they won't ask for any but be prepared! They can be tight and if your OR wants to play it by the book then you may be out of luck. On the plus side your IPA will definitley be going down as I imagine you will now have considerably less surplus.

    i have spoken to my OR as im dischared next month and might get made redundant after this tme

    they can't touch it, they can ask for part of the interest each month if any as this is an income but they can't take the payment unless its for time in leiu and you get another job so paid twice or un taken holidays
