Help !!!! About to apply for Bankruptcy

Options
Im new to this forum but have been reading the advice for several weeks now. Ive struggled along for so long now, I have taken advice and my best solution is Bankruptcy. I have several questions which i could do with help on.

1. Im employed as an Operations Manger for a company do you have to apply to the court to carry on doing this job. I noticed on the bankruptcy form a question about being a manager so im not sure. I have been open with my employers and they are happy for me to continue with my job, there are no restrictions in my contract of employment.

2. I have a mortgage with my partner and have to support my daughter(who doesnt belong to my partner). I do not get any maintenance for her. Can i put down extra on my income and expenditure costs because im having to support her fully.

3. I have moved out of the home and had to move in with my parents for the time being. My husband cannot handle the situation im in (suffers with depression) although we are working on our marriage and my daughter is still living in the mortgaged home. I have told my creditors that i have moved out. My parents arent charging me anything because im still paying the bills on my property to support my daughter. My husband and i plan on recovering the marriage but it is going to take time because he wasnt aware of the debts. (kept it to myself so he didnt worry about it). There may be a little equity in the property which im aware he could possoble buy out. Im confused would he have to have the mortgage all in his name or could i still be on the mortgage if the bank was happy and just buy me share of the equity.

    Hello and welcome

    1. I beleive you are reffering to the "Promotion, formation or management or any company" rule, This applies to people at the very top of a company who have a direct say in the direction and stratagy of a company as a whole, not middle managers. How close to the top are you.

    2. Basically you can only put down expenses for where you are living not for any other properties or for people not living with you.

3.The mortgage stays in both names as does the legal title, all that changes hands is the right to any money if the property is sold

    hope that helps
