How to deal with Triton?

As I've mentioned on here a few times I've an outstanding debt to NatWest which was part of a complaint to the FOS which I unfortunately lost.

Since then, I received a letter from Bryan Carter telling me to contact Fredrikson.

I have sent two letters to each of them, making repayment proposals which went unanswered despite them signing for them.

Yesterday, I sent a new proposal in the post, this time to Triton as I received a random email from them last week.

Today, I have received a "Final Notice of Intent - call us today" letter, albeit dated 11th October giving me 72 hours (which is obviously now passed) to contact them.

Should I just call them and inform them that I've sent them a letter with a detailed proposal? Will they accept that explanation over the phone?

Or should I just wait for their next move given I've sent them a letter?

Just make the repayment as promised in your letter, you can only pay what you can afford. Don't ring them.

The biggest problem I'm having is that I've been asking them to confirm where I have to make the repayments to and they have not bothered to respond.

Just write to acknowledge their letter and state that you have written with repayment proposals and the dates. Tell them that you need confirmation of where the repayments should go. Keep copies.

Ultimately, I think they want to try and set up a Direct Debit. You should not do this, you should set up a Standing Order if you want to make a regular payment. Do not set up a standing order with them over the phone, they will abuse this and set up a Direct Debit.

  • Can I just ask why a direct debit is a bad idea as opposed to a standing order? Thanks

Because a Standing Order allows you to tell the Bank exactly how much to pay and when. Direct Debit is always for variable amounts on variable dates as demanded by the payee - not the payer. The bank does not know how much or when, these details are entirely between payer and payee. Debt Collectors in particular will play fast and loose with Direct Debits and you are relying on their good will if you have to cancel a payment - which may cause bank charges etc.

In addition to the above a standing order allows you to remain in control. How many complaints have you seen about energy companies increasing DD amounts with very little warning.

They only have to provide you with 14 days notice. Some DCA's won't even extend you that courtesy. I have seen threads on here where DCA's have cleared out peoples accounts by upping the DD and not informing the debtor.

Yes its immoral, but its not likely you'll get your money back, and even if you did it would take weeks.

Much safer to set up a standing order
