Does anyone know of any cases whatsoever where the csa has abandoned the order and not persued the claim due to any reason whatsoever?0 -

But there are no easy answers. Compile the info and where the CSA have got it wrong, appeal it.

I did sign on in the early years roman but about 5 years ago after my last unemployment ai didnt sign on because they said i hadnt paid enough NI to be entitled to job seekers, after that point i have been largely invisible0 -

I'm sorry you're going through this - it makes me really angry to read as I know several women who were married/partners with men who just upped and left - and now seem to be getting away scot free, making loads of money and not paying a penny to their children. Why are they pursuing you and telling my friend they can't get any money for her! Gah!*Insert interesting words here*0

I know mrs wassire, the point is its not about me v's the childs mother, there is a child in this, however he doesnt even know about me, the mother has brought him up with a female partner, she never wanted me to be any part of his life (nor did i want to to be honest) but the seem to persue every channel possible for the likes of me, where as my new partner who has children by her ex husband recieves £7.50 per month!!!
The brutal truth is I havnt payed, its my own fault, but I believe the circumstances dictate that I shouldnt be liable for this payment! unfortunately the csa dont see it this way, they just see a number!0 -

yes kellogs i did tell them years ago, i told them i couldnt afford to work and the guy on the phone basically said it wasnt the csa's fault and just kept asking me if i thhought the assesment was incorrect.
Like i have said the assesment cam down to £11.50 or something a week but i didnt pay because i wasnt working and couldnt claim jobseekers so effectively i was a house husband, i did tell them this but they apparently have no record! so recently they have done a new assesment without me filling any forms in whatsoever and come to the conclusion i should be paying £30 per week and they have back dated this sending my arrears sky high!0 -
kellogs i am particularly interested in any advice you can give, having read some toher posts i believe you are somewhat clued up on the workings of the csa.
I believe that nay person male or femal having problems with the csa believe they are all numpties anyway but they are only doing a !!!!!! job, it does seem that everything is black and white to them when in reality life isnt that straight forward.
I am due in court on the 17th of november, I am supposed to have paid 2 x £100 payments on the 17th of september and october respectively before my appearence in november. However should I choose not to pay the agreed amount does this hinder me in any way, The reason I am thinking of not paying is due to the fact that i simply cannot afford the payments and also that I wish to challenge the amount, I know i agreed that amount originally but I now know more about the situation than i did before, If I do pay the £100 payments there is NO chance of them reducing the payments for me because they will say I can afford it because I have paid it.
However if i do choose not to pay it court will be very cross with me I assume.
I am applying for the data protection thing and will seek legal advice, what do you think the best course of action is for me?
Ideally I would like to not pay anything, however I am of the opinion short of blowing the csa towers up this is not going to happen so I have to just suck it and see. So i would like my payments to be as low as possible and the arrears to be either reduced dramatically or wiped clean!
I know alot of people will frown upon a father neglecting payment for his child, however my situation is that of a sperm doner!0 -

14 years ago aged 18 I slept with a girl on a few occasions, she was 6 years older than me. I went on holiday and came back after a fortnight to find that the girl I had "been seeing" had got a council house and moved in with another women. It became apparent that she was indeed a lesbian.

I had my final assesment some 5 years ago when it was deemed that as I no longer worked I had to pay £11.25 per week. I had been living at home with my parents, unable to get a proper job because everytime I did the csa took huge portions of my wages leaving me with next to nothing so I took the stance not to pay as I wasnt working. I had many a phonecall to the csa to try and resolve the situation, asked for payment slips so I could pay when I was fortunate enough to have spare money, I asked them to re assess on many occasion only to be told "its not our problem, your circumstances havnt changed"
I was summoned to court in july and the guy from the csa was far more understanding than any of the other dimwits I had spoken to, however he did say the arrears had gotten out of control (£5000) and if it wasnt addressed then a custodial sentence would occur, I agreed to pay £100 per month as I have now got a small job on minimum wages (sub contracting) I was asked to pay £100 per month for a period of 2 months then re appear in court in september, I did this and appeared on the 17th of september, the guy from the csa then said to me that the £100 was for arrears (£5000) and the new payment they would be seeking would be the "minimum" £30 per week for future csa payments, taking my total payment to £220 per month, I simply cannot afford this money, added to this they have since sent me a letter stating that my new payment of £30per week has been backdated to 2007 when I was last in employment, I explained that I was in employment for 6 months until the contract ran out but he says because I didnt notify them they have to back date it, the letter now states my arrears have gone from £5000 to over £10k.
I am due back in court on the 17th of november.
The reason I seek advice is over the past 2 weeks I have fresh information and I am wondering if this will affect the csa and the decions they make.
The mother of the child was a lesbian and her partner at the time has since approached me and explained a few things, they have now split up but she said to me that The mother targeted me to get pregnant, her words were that they used me as a sperm doner, she seduced me and had the intention of getting pregnant and never had any intentions of letting me see the child, be part of his life or anything, her sole ambition during this period of her life was to get pregnant, I wasnt the only person she had targeted either. The 2 lesbians had planned it for months for 1 of them to get pregnant and get the council house for them to move in together, mission complete I'd say.
Do these special circumstances change anything as far as the csa are conceerned, would a judge take pity on an unsuspecting individual like myself, I clearly had no idea she was a lesbian at the time as she was much older and from a different town, however when they had a house together rumours did surface from other people who knew of her.

sorry didn't read your first post properly about the conformation you are the childs father. I think you need to research your dp files and try and get a reduction on your arrears if possible. It is not up to the court to decide if or how the arrears are made up and are not allowed to ask unless it is blatantly obvious they have made a mistake. You could possibly get an adjournment until you gather your evidence
Good luck anyway but after all the child is still yours and the courts or the csa will alsways say access and child support are 2 seperate things.0 -

Unfortunately many men who haven't taken care of contraception are in this position, whether the woman is lesbian or not.Please do not confuse me with other gratefulsforhelp. x0
