Urgent Help needed please! RMA & Credit Card debt

Hi,
Can someone please advise me please? My credit card debts were passed to RMA by Barclaycard. After much hassling over a long period of time RMA asked if I wanted a settlement figure. I said yestout of curiosity. The settlement figure was good and I started to feel light ast the end of the tunnel, so borrowed the money off a dear friend, pending the sale of my home, to get them off my back. I was told to make the payment through the same channels as I've been making the token payments, ie direct to barclaycard. I did so on Monday. NOW RMA are saying that the money should've gone to them and they would then tell barclaycard they have the money and ask if they would accept it in full and final settlement. They are saying that barclaycard will now chase me very hard for the rest of the money - which I have no way of raising! I have letters from RMA stating "Barclaycard have agreed to accept the sum in full and final settlement". Not sure where this leaves me now and I am absolutely distraught & breaking my heart while tying this. Can someone advise me please?

    So you have letters proving that exact wording?

    In any letter that says that, does it state how/who should be paid?

  • Yes I have the letters from RMA stating that. It says to send the payment to them. I was however, advised by phone prior to receipt of letters, by one of their employees to make the payment the same way I do with my usual monthly payments ie direct to barclaycard, as I don't have a cheque book. I asked him to confirm a 2nd time during that call, that I could do the payment online the same way as usual and he said yes. Since then he has rang me a few times asking when the payment would be made and each time I confirmed with him that the payment would be made directly from my bank by the usual means. At no time did he say anything about sending them the money as they are aware I only have a basic online bank account now. Surely barclaycard can't chase me for the rest when I've got written confirmation from their agents that they'd accept payment in full and final. Can they? I'm worried to death now.

    A creditor is responsible for the conduct of the people they employ as agents.

    I would forward a copy of the letter direct to Barclays requesting that they confirm in writing that the debt is now settled with them. i.e. bypass the fools at the DCA.

  • I tried to speak to Barclaycard but as soon as they brought up my details said it was with RMA so they cannot discuss it and I'd have to speak to RMA! I was really upset before but now I've settled down I'm furious. If settlement payments have to go to the agency they should make it perfectly clear. They knew I was doing the payment online and at no time did they give me their own bank details, nor did they specify the settlement payments weren't to go directly to barclaycard. I confimred in every call that I was to do the payments the same way I did the monthly ones. They asked me to cancel the payments but the money is already with barclaycard. They're now saying they will try to sort it out with barclaycard, so I'm waiting to hear back from them. They're clearly more concerned at their loss of commission and don't care about the distress they cause to joe public! I thought all the incessant calls would cease once payment was made but they haven't stopped calling all week! I think I'll take your advice and for my own peace of mind, write to Barclaycard enclosing a copy of RMA's settlement letter and ask them to confirm the debt is now settled.
