Parking eye...sore!

Hi, new user. I have just received a ‘PCN’ from parking eye for parking in a supermarket car park without paying. I am a disabled driver with a blue badge and said supermarket use to allow blue badges holders to park for free. Signs had been displayed saying that a new parking system would be in place ON 24/25th August. I understood it to mean the system was live on those days only, and not from those dates. The date of the ‘PCN’ is 17th September however my car has parked in that car park many times since that date. On all occasions someone else was driving for me (insured to drive) and used the badge as directed. My concern is whether this penalty is the first of many to hit my postbox? Should I ignore them as although I am the DVLA registered keeper I was not the driver? Read a few posts suggesting that these charges are potentially unenforceable. What if I were to get further penalty charges?

    Ignore ignore and ignore.

They will send the registered keeper a lovely collection of invoices and letters saying that they "might" take you to court, but I believe Parking Eye don't do court. If the car-park was free then the most the landowner can sue for trespassing damages is zero

Just ignore. It's as simple as that.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?
  • Even if the potential revenue could amount to hundreds of pounds per ticket? Would they consider that a haul worth going to court? I'm panicking at the thought of being summoned to court. Say I ignore all the initial (threatening?) letters when do I eventually write to them to back off?

you don't write to them.... ever. You ignore all their letters, see here for what to expect:

To date Parking Eye have never issued a court claim, they give up on anyone who ignores their threats.

When it becomes harassment in which case you can sue for this:cool:

    Hi RadMan,

    Welcome to MSE :hello:

Take a look at the letters in this thread and hopefully you'll see that the PPCs' tactic is to scare people into paying though use of threats. When they realise the subject isn't going to pay up, they leave them alone.

Also, their alleged contract is with the driver - not the owner of the vehicle (there is no requirement for you to tell them who the driver is - indeed you may not remember - the date of the PCN is almost a month ago).

Despite this they will harass the vehicle owner. Don't give in, stay strong and if you're ever worried by their letters, post on this thread for advice and reassurance.

Car park was pay for parking and rebated by the supermarket if you shopped there. Free for blue badge holders. What's peoples take on the notice board saying 'ON' rather than 'FROM' (see original post). Would that count as being misleading? I took a photo of it for proof but will be ignoring the invoice. The sheer number of posts on here has given me heart that advice and encouragement will be forthcoming if and when required.

So maximum losses could be a pound (assuming you didn't shop at the supermarket). Assuming the PPC has jumped through lost of other hoops such as agency rights and suing the right person.

Of course, nobody gives a toss about a quid and Parking Eye have never and will never do court.
