what about 2yrs before?

Brief summary
sons wife walked away 3yrs ago leaving him with 2 boys. He worked full time till then .Had to give up work to look after his boys.Apllied to csa for maintainence they said 2.50 per week per child was all he could get.in all this time and after many calls not one penny.She is living with another man who works fulltime.She also has a daughter from a previous relationship and gets 20.00 per week from him.Today the csa has written to my son saying that his entitlent from her is nothing as she has not been eligable to claim from march 2009.The boys are 8 now and were 5 when she left.
do you think this is right or should he be entitled to the 2yrs before?

    She must be in receipt of benefits if all your son is eligible for is £5 per week.

    Doesn't matter what she is receiving with regard to child support from her 1st daughter, nor that her partner works full-time, it is her wage/income they are interested in. She may be receiving child tax credits or work tax credits which can be used as assessable income, but maybe CSA not aware she is probably receiving these

    I do not know if she is in reciept of tax credits,although she does not work ,son was awarded the 5.00 at the begining and has not had one penny of it.Aftr many phone calls, he was told that 5.00 was oing into a building soc account but that cant be as he does not have one so its a piggin muddle and the guilty party again gets away scott free.
    sorry to rant and thank you for taking the time to answer.These georgous boys are costing her nothing, its son and us who are looking after them.
