Wonder if anyone can answer this?

My partner is the RP to his two children with his ex, she has paid CSA for the last few years although with problems at times. When she moved out she moved 30 miles from my partner. Because he is a good man, he used to take the children to her weekly at the weekends and she would bring them back. In 2005 he and the children moved in with me which then made the journey about 52 miles, the same still applied and he took them to her on a fri and she bought them back on sun.
She then moved another 20 miles away, and had 2 pregnancies where his CSA went down due to her being on maternity leave.
She has now decided to go part time at work, which will halve the CSA payments my partner receives, my question would be as this will be such a small amount, would my partner still be legally liable to take the kids to her each week? We just won't have enough money to do this, we have another 4 children at home.
Sorry this has gone on for such a simple question lol

  • Unless there is a court order saying so, then no, he is under no obligation to deliver the children to her. She may then request a variation in her CSA amount in order to contribute to the travel costs, though.

    he's not "legally obliged" to do any of the above.

    if the NRP chooses, she can put in for a variation on her csa assessment based on travel costs she incurrs.

    the only time he would be required to make the journey is if there was a valid court order in place specifically requiring it. most CO's state "resident parent shall make the child/ren available for contact" not trapse round after an ex that moved away.

  • Thanks for the answers both of you, there is no court order or anything he's just a nice bloke, but when it seems the amount he will get from her will not even cover the weekly journey, i don't think we should have to use family money to pay for her convenience. Happy bunny now thanks :o)

    You can also apply for a Cour Order to define the contact and how the Kids are moved from one parent to the other!
