Received letter from 1st Credit

I have started to receive letter from 1st Credit regarding money owed to Lloyds TSB. It was either regarding an overdraft or loan that was owed. It was taken out a few years ago when i was with an now ex partner. Its all in my name and now they have caught up with me. After looking at this site i have sent the 'Prove It' Letter. How long should i wait for a reply and what if they cant prove anything? Is there any other letter i need to send? I have not paid anything on the account in years. I believe its in the 5th year and will be 6 in June next year so not yet statue barred. I now have 2 young children and work only part time so wouldnt have a chance in paying back the money in full as they request. I am also due to move house in the next couple of months do i need to give them the new address? Any useful help on this matter would be greatly received.:)

    Might be wise to give them the new address - many dca's will purposely get court papers sent to your old address, so you can't defend and they get judgement by default.

    Whatever you do, don't admit the debt - send a cca request as well. You just need to hold them off until it's statute barred.

    if it was an overdraft a cca wouldnt have much effect, a loan they would jsut need to provide a copy of it or a reconstructed one. As others say if you just move without telling them they will just go to court, get by default and add more charges to you.

    Wait and see what they send back after your prove it letter.

    Then send a CCA request and see what (if anything) comes back, they may bail out at that point or start offering very low settlement figures. You never know with this bunch though so be careful.

    Thanks for that info. I sent the 'Prove It' Letter and got a letter back saying 'Your letter has been passed to the appropriate department and they shall respond in due course'. Since then i have received another letter attaching my lastest annual statement detailing all financial transactions from 1/10/2009-30/9/2010 (there have been none). It then goes on asking me to contact them regarding convienent payment options. It doesnt look to me that the letter is answering my qustion of proving the debt, would i be right? Do i now send the CCA request letter?

    Sounds like they are determined to not let this one go barred, it's very usual for lenders to have a big "final go" in the last year of the debt.

    How much was this overdraft? if it was quite a bit, they'll get a CCJ against you and then it's legal and trashed credit for multiple years.

  • I posted on this site October last year regarding letters i was receiving from 1st credit. I had some useful information. I sent 1st credit the CCA request letter enclosing £1 for the information. I received a letter back saying that they were trying to find the information i requested and would be in touch. Since this time I have not received anything. Yesterday my husband answered the phone and it was 1st Credit.

    I have not yet called them back but imagine that they will be calling again soon! Should I call them back and request that everything be sent in writing? To be honest I am not sure how they even got our telephone number as we are ex directory.

    Also the money that they are requesting is possibly now Statute Barred. Looking back it must of been just over 6 years since any payments have been made. Any contact that has been made was by letter that I did not acknowledge any debt. If this is the case please could someone let me know what I should do now?

    If it was a loan then send them the CCA letter.
