CSA Arrears reinstated

Today I received a letter from the CSA that stated they previously decided they would not collect £2,139.13 that I owed from period 01/06/95 to 15/06/02. However they have now decided that I have to pay this amount. My children are aged now 30 and 25 years old, i.e in 2002 they were 22 and 17. I am quite shocked and stressed by the lettter which comes with the usual threats of pay or baliffs, imprisonment, no driving licence etc.
I have not had any communication from the CSA regarding pervious arrears and must be well over 10 years since I have heard from them about anything. I've always paid my dues directly to the CSA, including too much at one point because I was wrongly accessed and took a letter from my MP to stop them. I even got a refund...I know that surprised me too.
What distresses me now is I thought all my CSA days were done. Can they do this and just decide that I have to pay more now without proof. After 15 to 8 years I dont have any bank statements that would prove I paid them, I am sure nobody would have. Is there some Statute of limitations on the CSA.

I have remarried now and of course not a very nice thing for the wife to have to go through. Plus would / could they make me pay according to our joint income / savings etc.

Any advice would be most welcome in how to deal with these people.

  • We are going through exactly the same thing - almost identical story. We have requested copies of the files - contact NACSA - they are very helpful and should see you though it.

    Get your data protection files and go through them. Get them to explain how this debt came about in writing. The majority of this debt will be statute barred if you live anywhere bar Scotland
  • thats the worry now....a lot of peoples maintainence will have stopped the first week in september so their targets will be down,so it will be make as much arrears to the people who have paid with no fuss, so their targets don't drop too much and rake it in that way...my daughter went uni first week in september i'm still waiting for them to contact me to say my liability has stopped... i contacted the child benefit 3 weeks ago and still nothing....if they had wanted wage slips from me i'd have been given 2 weeks to respond :(:mad:

    i think that it may come in the realms of statute.

    well worth checking out as it's not the first time i've heard of them trying it on with an unenforceable debt.

    defo get onto NACSA and your MP.

    what you have to remember is that they are a bunch of overpowered, incompetent muppets who haven't got a clue what they're doing, so it's often worth getting the ammo you need and fighting back.
    NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.

    I believe like Speedster that any arrears prior to 2000 are statute barred, but again NACSA are probably best bet.

    Doesn't stop CSA Muppet Show from trying tho.............does it!

    Why were the arrears suspended, and why have they now decided to collect them? If you don't know, they should be amongst your first questions. You should also be asking for a full account breakdown, right from the start of your case.

    Thats the point I dont know why the arrears were suspended. I dont even know why there are arrears. Ive paid all the time during this period and hadnt heard from them until now. It has been 10 years since I last heard from them.

    Also they seem to have good access to being able to find where you are...I have moved house three times during that period and moved to a different county.

    Anyway, will be contacting the NACSA to see if they can help and writing to the muppets requesting an accounts breakdown.

    They have access to credit reference agencies....same as the tax credits people. If you're going to write send it recorded delivery, but I would phone and ask them anyway. Then you can give NACSA the full details, and maybe get some advice from here.
