child benefit on the bankruptcy forms

I wonder if anyone can help. What is the best way to “account” for Child Benefit on the Bankruptcy forms. Do you include it as income and then indicate it as child costs. And if you do will you still be allowed to account for other child costs like school meals and clothing etc. thanks for your help.

    Child benefit goes in the income section, Not sure what you mean by account for it, but you simply put whatever your expenses are in section 7

  • Sorry if my first post was confusing. The CAB told me that the officials in bankruptcy cant include the child benefit if there was to be an income payment during the bankruptcy. And I was just wondering how you account for it in the expenditure. I think you have told me what to do which is just list all the childrens expenses.

    Hi depression,can I ask where you got the forms from? I phoned our local court 2 weeks ago for them to send them to me.....still waiting! That is the bit i am dreading,what to put where, How are you getting on x

    I live not far from the county court and went in for the forms. And I am lucky because a CAB adviser is helping me fill them out. But she is incredibly busy and I hate to take too much of her time, this forum is so helpful for the bits that I am not sure about.

    I didnt think of going straight to the court doh! I have to agree with you about this forum,these guys have,literally,saved my sanity,my marriage,and to be honest probably my life. We have been struggling for years and BR is now our only option,i couldnt talk to anyone about our problems,coming on here is such a release,sometimes i dont participate in the discussions,I just look around and see what is going on,I actually get withdrawal symptoms if i dont log on!

    No the child benefit is included , just that you wont be given an IPA if your income is SOLELY from benefits.

    The simple thing to do is just put down all income and all expenses, the forms are not about you working out if you will have an IPA they are just there for the OR to collect the information for them to make there decisions.

    You should not be trying to preempt them in any way by deciding what to put down or not, you should simply be putting down the information that is requested

    I understand I'm not in anyway trying to avoid or work out any income payments as you say it is up to the officials not me I just wasn't sure about the child benefit. I think my CAB adviser was just trying to be helpful by telling me that if there was a income payment she thought it shouldn't include the child benefit which is the only benefit I get. But I will leave it to the officials to decide.
