Getting a mortgage on posessionary title?

We are buying a house with a long garden (100ft)

Halifax agreed the mortgage.

The solicitor has discovered that 40% of the garden is in fact unregistered and has said that they will inform the Halifax

I assume that if the regstered land is passed to me their valuation will be reduced (though not sure how much garden land is worth). Anyone any experience of mortgage lenders dealing with this?

If the vendor can get posessionary title by applying to land registry and then gets an indemity policy on it, does anyone know

a) whether the value of the land therefore remains as we thought it was

b) whether Halifax, or mortgage lenders in general accept this kind of arrangement?

Shouldn't be an issue. As you can still build on it, sell it etc. The indemnity policy will protect you should someone subsequently make claim to the land and be awarded title.
