stung by ex over csa

my partners ex wife has really stiched us up. we had a voluntary agreement with her and paid her every month but now she has gone to the csa and we have to pay £400 nper month! The thing is the eldest child has not been in continuous full time education but her mother has never stopped claiming child benefit. The csa believe that we owe money because of this when infact we dont! Now my other half has had a break down because we are streached to the limit financially. He is signed off sick with depression do we still have to pay all of this? Is there anywhere that we can get help?

    Ok, firstly does your partner have shared parental responsibility?

    If he does, he can approach the college the child attended last and ask for written verification of the child's attendance and effective leaving date.

    It is quite common for this situation to occur - unfortunately!!

    You could also ask for an appeal against the assessment (put it in writing, recorded delivery to the Central Appeals Unit), you must do this within a month of the decision, or 13 months at most. If CSA Appeals they will not change the assessmant despite your evidence, then this gives you full appeal rights, whereby you can ask for your case to be heard before an Independent Appeal Tribunal, and then, it will be heard by an Independent Judge will will ask for lots of evidence from both parties, and make a decision accordingly.

    Let us know if we can help any further. Think appeal may be best option, also try and gather evidence against the PWC as she is committing fraud - may be worth a call to Child Benefit Office also
