re assesment back dated past point of contact

basically ask for reassesment in 3 dec 2008 i was in formed in april 09, i provided my detailks at the time and assesment was made, she appealed and they then made a new assesment on me being a soletrader(which ended 30 nov 2008) has the moved her affective date to 27 nov 2008.
i was a director of a ltd company from 30 nov 2008 but im beaing assesed has sole trader from dec-april 2009 even though i was a director.

how can this be correct, if i didnt tell them i was earning more they would back date it but if i didnt tell them i was earning less they would leave it?

i was happy with maintence so had no reason to inform csa and knew nothing of a re assesment untill april( even though requested in dec) so if iwas told early iw ould of told of change of circumstances and had this assesed properly.

can they do this because of there neglect.

The earliest I thought they could do the reassessment was he date the PWC asked for it. So December. They don't care if you weren't even aware if a reassessment for some time after unfortunately.

but then surely this is unfair because if i knew of the reassesment i would of made sure they were aware i was a director and not a sole trader.

i didnt inform them has i didnt want maintence reduced and was happy with what i was paying.

i could i not appeal has there assesment is basically only ligitamite for 3 days then my circumstances were different??

Have you asked for a reassessment for the new change of circumstances?

I know it's not fair but it's their policy.

they know my circumstances because of the info i sent in april but they now say i have arrears to pay

So have they done the reassessment correctly? From the time the PWC requested it?

It's the risk you take not updating them with your changes of circumstances. They can backdate assessments to when the PWC requested it, even if it took them months or years to action it.

yes but i had no reason to get the maintenance reduced i was being fair....and its not fair that you are not informed about a re assesment for 5 months not giving you the time to say.....actually these are the circumstances now.

and also they move the affective date back so all though assesment was requested on 3 dec(when i was director) they move it to 27 nov(when i was classed has sole trader)

I agree it's unfair, but that won't change the fact that the CSA won't do anything about it. It's how they work and we can't change it.

I would however, ask them for an explanation of why it's been backdated to before the PWC requested a reassessment. As far as I was aware, that is not allowed.

they have told me it goes back to an the tirst effictive date ie if the claim started on monday it goes back to the previous monday????

which takes it back to a date when i was a sould trader. but hey two days later i wasnt???
