Brief outline me and the exOH seperated about 3 months ago, I have moved out of marital home and into a privately rented flat. I am on JSA contribution based and pay my own rent and will receive LHA to help with rent when my amount in bank comes down to the level the help is allowed.
My husband owns and runs a garage and MOT Centre and it has been run sucesfully for over the last 8 years, he employs 3 mechanics and a young apprentice.
Today one of the mechanics wifes stopped me in the street and said the men had not been paid as usual on Friday and did I know what was going on.
To cut a long story short the exOH has been siphoning the profits from the garage and pocketing them and the cashflow problem has appeared, there is a delivery of fuel due tommorow Wednesday and they have stopped his credit and if he doesnt pay up front then it does not get delivered.. so no fuel no petro lside of business.
I have been down to the garage this morning and spoke to the chap in charge of the MOT side and he says that unless there is some money put back in to the business then it will be insolvent and he said why did I have to ask for a large cash payment from my exOH as this has been the cause of the business about to fail:eek::mad::mad::mad:.
I have received nothing from the ex OH from the day we parted and have used my own money to finance my flat deposit and living expenses. Tried to get in touch with exOH he is on a cruise with blonde pregnant floozie:o:o...I am a midwife and was made redundant 3 months ago with a good redundancey payout.
He did reply to a phone call saying with words to the effect that I could fluff off and he was going Bankrupt when he came back of his holidays and I wasnt getting a penny as it was all spent and the employees can sling there hook as well:eek::eek:, these folk have worked for the garage from day one and are like family and he is just going to chuck it all on the scrapheap.
Garage is a Limited Liability Company and the mortgage is in both our names and part of the business loan was secured against it, the house is worth £195k and the business loan is for £35k... if he goes Bankrupt will all the debts he has run up in his name be passed over to me???
He has 2 credit cards maxed out £2k and £5k and he owes the men one weeks wages so far and they are all looking for new jobs, Im so ashamed that he has driven this very very viable business into the ground in 4 months.
There are rumours coming to ligh that he has gambling debts??? and the parents of blond floozie have both got new cars and paid of there mortgage care of exOH, I think he has lost his mind and his brain is in his trousers.
I now need to protect myself and my future credit rating, I am not involved with the garage in any way other than with the business loan being secured against it.
If he goes Bankrupt will I be liable for all the personal debts he has and business debts, I dont have any finances other than my redundancey payout and my future NHS pension, had hopefully was entitled to a share of the house when we divorced that now looks unlikely now.
Any advice would be most helpful thanks

 You would become liable for any joint debts in full if he did go BR.
 How much equity is there in the property?
 And if there are gambling issues, and money being given to others for cars and mortgage, then the OR will look at his case in depth.0

 I am wondering whether you would get a degree of "protection" from HIS problems if you were divorced from him.
 Might it be worth finding out just how fast/cheaply you can "cut loose from him" with a divorce and whether you would have any added protection from him if you were divorced?
 Dont know how these things work - but just wondering if that would help.
 As I said elsewhere - you are definitely well off without him.
 I do hope you get your share of the assets - rather than finding he has blown them on gambling and the floozie - as well as his own share "going west" due to his thoughtlessness/selfishness.
 What a b****** to say he doesnt give a darn about his employees:mad:.
 Hope you manage to resolve this situation by finding a way to "stick all the pain in an envelope and mail it all to him" - and that neither you nor anyone else suffers because of that selfish ******.
 (Of course if you need an Old Style Board "posse" for emotional back-up if you confront him - there might be a few of us living in your neck of the woods......)0

 Just to wish you well in the dealings with your OH what a bxxxxxx! sounds like my ex really, he went BR after crashing all our finances and his business into the ground - kept me totally in the dark it is only now nearly two years on that I am undoing the mess he left. I ended up having to file for BR also due to joint debt {the mortgage and a secured loan} as once he was insolvent I was liable for the joint debt. Although I was never involved in his business debt in anyway so that was included in his BR. So it depends on what you have in joint names.
