Council tax, attachment of earnings?

AS some of you know my husband and I went BR on 31st March. We had a few problems paying our council tax since, bank messed direct debit up since getting new account etc...anyhow we now have an attacment of earnings on husbands wages for £246 permonth which is £100 more than our offer of payment Can they do this is we are both currently BR?

did you not fill the paper work in when you got it

Assuming the balance is subject to a Liability Order and is not covered by the bankruptcy then the council are within their rights to issue an attachment of earnings order. You can ask them to withdraw it but they dont have to.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
