17 year old daughter not getting minimum wage!, help??

Hiya,
I have posted on here in the hope someone can keep me right. My daughter has been working in a childrens nursery for 6 months, and I have been telling her to get her contract of employment sorted out. She got her contract home today and I was horrified to discover that she is only getting £2.25 per hour. She turns 18 next wednesday and asked if the rate will increase at that time. She was told no, thats the rate it is now and will stay. They said something to do with the fact she is getting "on the job" training (of which I have seen very little sign) Is this legal?

I have been to the Careers-scotland website and found some info about minimum wage, but I would really like to speak to someone who's been there or has insider knowledge!

(Also my daughter is very quite and shy, her "boss" is her boyfriends mum and I think she thinks if she rocks the boat she will have no job and no boyfriend!!)

  • I know that theres no minimum wage for 17 year olds but there is for 18 year olds. I also know that theres a phone number to report your employer somewhere. If I can find it I will post it. Good luck!

    surely a 17y/o should get more than £2.25 an hour, i know i got more(a different kind of work) than that and i got training when i was 17,

    My son was in the same position, he was on £2.50 an hour and in the end a friend of his boss told him he was breaking the law, and so boss increased his wage to £3 an hour with apologies. He did agonise about it though as part time jobs were so difficult to come by and he was just so pleased to have got one which fitted in with his schooling.

    The minimum wage laws apply in England, Wales, Scotland and Northern Ireland. She should be getting £3.30 just now and £4.45 as soon as she turns 18. If she's too timid to say anything to her then maybe you could have a word. If that doesn't work i'd get on to the inland revenue they have a NMW helpline 0845 6000678.

    Hi,

    One thing you might want to look into is if the job is classed as a modern apprenticeship which is trainee status. If this is the case then the minimum wage does not apply. This is the only exception I know of. I think the minimum apprenticeship allowance is £80 per week. Either way it should all be on a employment contract.     If they are claiming training then she should ask for a proper training programme so that she can then see what she is learning and, more importantly, when she is not learning.

    The minimum wage is £3.30 per hour which applies to all workers under the age of 18, and 4.45 per hour for workers aged 18 - 21 years. However the National Minimum Wage doesnt apply to apprentises (under 19) or workers on certain training schemes. I cant comment on your daughter case (as her contract could mention training), but I would certainly recomend giving the National minimum wage helpline a call on 0845 6000 678, as they will be able to give further advise. Any call would be confidential.
