~Breach in DPF~Help/Answers Needed~

    If no success with 192, try ringing the Council Tax Dept that other half will have been billed from in 1993. Just know that for our recent Tribunal I had to ask for copies of Council Tax bills for last 7 years and Council Tax Dept were very helpful. Just a thought that it may help with proof of where he lived unless he wasn't on a bill at that point!

    ICO address, yes I have it in one of my vaults where I keep my CSA files, but will be quicker if you go on their website it holds everything you will need.

    With regard to credit applications, Equifax, and CreditExpert may be of use to you, they will hold all credit application listed, but not sure how far back they can go. Again, if CSA have accessed his credit files, if you apply for a further DP File, it should be in there.

    We thinking of requesting another DP File just to see what has been written regarding our recent success at Tribunal, and revolution of their huge mistakes

    Thanx for all your help...you have certainly helped me to help others now..:)
    It's all wrong that we should be put in this place initially, as the CSA DO make ALOT of mistakes..and from what we can see they have 'lost' alot of things that we previously sent in from 2000 onwards from the DPF as well things that my OH sent before from '97 on...
    Still... onward & upward..:)

    Have looked at 192 but can find nothing so will get onto the others you've suggested later on today...

    Just wondered...along with the other breaches, do you think it is worth a mention that the DPF took well over 50 days in getting to us...thereby breaching the 6th Principle of the DPA???

    I am mud-slinging now..as I really do believe that either the paperwork from the MEF/IMA have been lost..or ( my REAL gut feeling is) they were never sent in the first place..and I believe now they are clutching at straws ( could be wrong..but it is a feeling I have had for a while now, as they have gone ALL round the houses with every reason they can find and each time I have answered with more evidence..so they have moved on with another stumbling block...

    Just wondered..are they likely to now miraculously 'produce' some 'made up' proof..(ie..quickly draft a letter/MEF/IMA and bung it/them in his DPF??) as I know they have been known to 'doctor' DPF's to suit???..and now they 'know' where he was living in '93 ( so they say)...I guess they 'could' make up the paperwork and back-date it???

    My mind is one step ahead at all times..wish it wasn't (Arrgg-hh) but they DO and HAVE played dirty tricks on others..so I am anticipating the worst scenario..and hoping to get the best...

    Think I might well request another DPF..JUST to compare notes..or maybe even go to NACSA and request that they take it ALL over ( not sure how much it costs now..but MIGHT be worth the money against the hastle and effects this is having on my health probs/disabilities)...
    Hope your case is moving forward..

    Personally I do think you are mud slinging, as a lot of the posts are based around a technicallity :o
    It puzzles me that he does not know where he was living, but absolutely sure he was not living at one particular address at the time :o
    But yes have a look at the NACSA site for an idea of the costing, they will be able to offer more assistance than anybody on this forum as arbitration is their speciality :beer:

    :) It does'nt puzzle me at all that he does not remember where he was living 'for sure' as he has lived at 12+ addresses since his 'ex' ( the QC's Mother) kicked him out in '92, and before we moved into our current address in 2001.. and all thanx to friends not wanting to see him homeless due to his circumstances..
    It's all factual..and sadly he got rid of most paperwork so we have nothing to look back on ( apart from,thankfully, his CSA file) prior to us being together in 2000 ( as most people get rid of paperwork once it is over 7 years old, as that is the 'recommended term')

    I don't believe I ever said that he was absolutely sure he was not not living at one particular address at the time, but if it came across that way then it has been taken wrong... as he did only ever live at one address at a time, just LOTS of different addresses in a VERY short space of time...
    I am not doubting the Agency for finding the address he was at..(IF they are correct) what I am saying now..as I always have is that he has NO paperwork in 'his' personal CSA file prior to '97..

    They have always maintained that he was sent both the MEF & IMA in '93...he has always said he never received anything prior to '97..
    His DPF shows NO evidence of either paperwork at ANY time..only dates they were supposedly sent, which were 'ticked' and signed in '96...

    That aside...he has still paid maintenance for a 'child' who it seems he may never know is his or not..and I just want to see justice for him..as I would for anyone in the same situation..

    Personally I have been on the 'other side' of the CSA and my ex husband got away with never paying for our daughter..Or IF he did I certainly never received a penny, as a working Mum...
    Once this is clarified I may well look into THAT issue as 6 years of no maintenance amounts to alot for any single Mum, and now I know that there is no time limit on an Appeal when laws have been applied incorrectly it puts a whole new light on both mine & my OH's cases...
    It is all wrong and VERY unfair when factual & proven parents get away with paying nothing and others who are unsure and have no way of proving the facts get penalised...:(

    :) Just thought I would add that I have called NACSA today, and have requested a Full Representation by them, as after telling them of each of the breaches they were more than happy to deal with the case indepth...:)
    Am still going to write to the DPU,ICE & ICO plus send my complaint I wrote at the weekend to the CEO,Complaints Review Team,Enforcement Officer and the Clients Service Director as I am appalled that not one of 'them' ever bothered to reply to any of my letters ( other than the Complaints Team)..and the only other correspondence we did get was from the Courts telling us the LO hearing had been withdrawn by the CSA...
    I was always taught that courtesy costs nothing, and that by writing to them all, I would at least have received a reply......

  • As previous post (~NRP~ Help Needed Desperately!~..only 2 replies to date ..
    One last week from CEO..one today from DPU..
    Wonder how long they would give US before taking the matter further???

    I've not yet joined NACSA for full representation..as I am waiting to see what they ( the CSA monkeys) come up with next...but it is next on the list..
    Any thoughts or comments..anyone???

    DPU took nearly a year in our case, to keep looking for our 'lost or mistakenly destroyed' missing documents, and finally admit they had indeed lost them, so just keep on at them, but as usual it could take a while..................and then some!

    Second lot of DPF arrived today..STILL no MEF or IMA from 1993..although there IS an IMA form from 1998 ( after OH had requested a DNA test and denied paternity in 1997... when he first received any knowledge of the case against him)
    Have now joined NACSA for a Full Audit on the DPF and will be contacting the caseworker in Newcastle who sent the DPF..also contacting everyone at St Leonards,Preston,Ireland and wherever else I have sent letters to in the past....most importantly the CEO..as he REALLY needs to know what a complete shambles he is running/in charge of....
    Give a monkey a computer..and what does he do???? lol
    Got to just add...I looked right through this second lot and there are emails between departments..and in one, one of the CSA workers has asked quite plainly..
    'Can you please explain to me in plain English that I understand, what this means, as I do not know if this is right or wrong'....
    What hope have we??.......

    Do you have any idea where the CSa allege he was living in 1993? It is dead easy to check the electoral roll in England and Wales for all years simply by going to your nearest main library and asking to see the electoral roll for that year. Unforunately you are not usually allowed to photocopy this, but can copy the details.

    usually it is in the local history or family history library.
