car issues in bankruptcy

as you may know i went bankrupt yesterday, just had a call from recievers office & they have said they may have an interest in my car :o(
its 10yrs old worth about £500, does anyone have any experiance of this? really worried now that i'm going to lose it, i have 2 young children & live in a small village with hardly any public transport

    You need to make a case to the receiver as to WHY you need to keep the car rather than want to if that makes sense

    I echo what Phil says. I didn't really think about the car when we had the or interview as knew my husband needed it for work . However, the OR asked whether he could get public transport etc and even though i knew he couldn't, i hadn't really come up with the facts and reasosn iykwim and just said 'no it would take too long and has to get 3 trains blah blah'. Although it was no problem, i just wished that I had actually made a case to keep the car and thought about it a bit more.

  • I agree, you need to explain to the OR why you need your car. I put my reasons on my SOA, then when I had my OR interview he just skimmed over the car really, I told him I needed it to get to work and that was fine.

    if a car is used for work purps and isnt worth an excessive ammount then an OR will usually not bother..BUT its no guarantee as everyone knows no two OR's are alike sadly

    Thanks Phil, i've had a good read thru that link you put up, i'm unemployed at the mo, but i am looking for work & as i live out in the sticks, i'm hoping that should be ok & plus the car isn't worth much against the £40000 debt?!?

    Al long you put a good case together you may be ok...as far as the value? i've seen cars taken worth a fair bit less sadly

    my mum only gave it to me a few months back so she will NOT be happy if it suddenly disappears especially as they don't know i've gone BR :(

    in that case then if your mum has any record of the purchase it cant be claimed as an asset
