Moj have on their site this Rule Breach Notice of Warning aimed at "authorised" CMC's.
Good to read up on the rules that CMC's should follow when taking upfront fees and cold calling

If you read the rules that CMCs have to follow then you have to say that it appears most frequently breach them.
I know the MoJ have suspended 200 firms so far but at this rate they are going to have to strike off quite a lot more yet as nearly a day doesnt go by without someone posting here that they have been lied to or misled by a claims company cold call.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0

I had a chat with a contact at the MoJ the other day - they are looking at more and more rule breaches each week
Also the FSA in a recent consultation document say "However, we do recognise that there are some specific issues about claims management companies, which is why the FSA, the ombudsman service and the Ministry of Justice will shortly publish a joint statement setting out our expectations." So maybe they will be getting tougher. honestly - most of them have practices that are worse than the practices that they are 'helping' people to complain about! We've spent decades teaching people about their rights, but nothing about their responsibilities.0

Common Sense 2, they are worse than the companies they supposedly putting complaints in about (you are actually lucky if they do "anything" with your complaint TBH after taking an upfront fee).Common_Sense_2 wrote: »I had a chat with a contact at the MoJ the other day - they are looking at more and more rule breaches each week

At least with the banks etc you do have the FOS but with these sharks you often have no comeback. Take that back, you can always wait for the next CMC to come along who ask if you have been unfairly treated by the previous CMC and so on. Its a joke how they have been allowed to continue and still do. I have had 4 phone calls today "saying "nat west have been this..... and Capital One have been that.....
Just glad to see that something just may be done about it now.0
