Think i'm entitled to DLA and being backdated

Options
Hey, i was recently diagnosed with Crohn's Colitis and depression. I have been going to the doctors for about 14 months but have been suffering with this for over 2 years now. My previous doctor i was originally seeing was clueless and sent me to specialists who claimed i had ibs if that... I have sent off DLA forms and am awaiting a response the replies i've been given so far indicate i'll get DLA but i was just wondering if i am 100% entitled to DLA and if so what type (ie low or high). Also is there a chance of me getting backdated and if i will how far ? Thanks in advance for any replies and taking the time to read this.

Whether you will get DLA or not depends upon what care and/or mobility needs you have, NOT the diagnosis.

If you are entitled, it will be backdated to when you first made your claim. I don't see as you have a case for it being backdated any further.

How can you prove what care or mobility needs you had 14 months - 2 years ago?

Suppose i can't prove anything and as for care/mobility i am awoken every night with stomach cramps and have to go to the toilet between 10-20 times a day and my stomachs bleeding more often then not everyday and i get stomach cramps which are shortly followed by the need to go a toilet within 30 seconds at best. Would they consider that worthy ?

Replies from who? Who has indicated that you would be entitled to DLA?

As seven-day-weekend has said DLA is based on your care and mobility needs NOT on diagnosis.

If you are awarded DLA it will be backdated from when you applied - the date on the form or from the day you phoned up for an application, if that is the case.

The fact that you are woken every night with stomach cramps or have to go to the toilet up to 20 times a day doesn't show that you have care needs and I don't think they would consider that to be worthy of a DLA award.

Do you need help to get up at night or assistance etc? Do you have mobility needs? If you have filled in the form surely from the questions, you would have a good idea of whether you would be eligible for DLA.

But i've been living on nothing for almost two years now unable to work or go back to uni.... Am i just expected to live like this on nothing ? Also i've seen loads of people on DLA with what i'd consider alot easier to cope with day to day diagnosis.

cg1351, I'm not having a go at you but based on the information you have given no one can help you. You haven't answered any of the questions I have asked - such as who has indicated that you would be entitled to DLA? You stated that you'd had 'replies' - replies from who??:

Are you receiving any benefit and if so what? I'm not sure what you mean about "day to day diagnosis."

Do you have any mobility or care needs?? If you are ill it doesn't mean that you are eligible for DLA. You have to have care or mobility needs.

lets put it a easier way do you need someone to care for you through the day or night ie cook your dinner help with shower etc.
    YES OR NO
also can you walk more then 50m without getting bad pain
    YES OR NO
If you answer yes to the top one you should get care side of DLA
if you answer yes to the bottom one then you will not get the mobility side of DLA
It doesnt matter how bad your illness is or how hard it is to live with it.

I'd be surprised if you get DLA on the information you have given. DLA isn't compensation for being ill, but to pay for the additional help you need from another person because of your illness. Some people with advanced or very aggresive crohn's do qualify for DLA because of care (and sometimes also mobility) needs, but it doesn't sound as if you have reached that stage.

Have you contacted the NACC? They produce a very useful guidance on claiming the benefits you are entitled to, and they also give grants to people with crohn's for things like washing machines, provided you meet their financial eligibility criteria.

Sorry, but this is wrong. I can walk 50m without pain; but get mobility because I need supervision outside due to sensory disabilities.
But i've been living on nothing for almost two years now unable to work or go back to uni.

DLA isn't for this - there are separate benefits for not being in work.
i am awoken every night with stomach cramps and have to go to the toilet between 10-20 times a day

But how will / does a person help with this? I have bowel problems too; because I also have additional disabilities, I need help from another person with the toilet problems. If you don't have any disability like that, you would be expected to self-care.
