I'm new to all this but would really appreciate some advice! Basically I would like some advice on a store card which has been opened in my name at a previous address. It appeared on my credit file by a debt collector - Aktiv Kapital - in July 2010. I rang them to find out what the debt was regarding and they said that it was a Harvey Nichols card opened in January 2009.

The previous address they had was my address at the time the card was opened however I did not receive any statements (possibly due to the fact our postbox in our block of flats was broken and our landlord - and ex-flatmate's mother - refused to have it fixed).

The person I spoke to was extremely rude on the phone saying that he heard people who said they apparently did not know where the debt had come from and said I had simply forgotten, especially as I am a student. He then told me to write to them to ask for all the details, which I did without signing the letter. Since then they were ringing me constantly chasing up this debt, regardless of me telling them I had sent them a letter stating the debt was not mine and to provide me with evidence. The calls eventually stopped and a couple of weeks later, I received a copy of terms and conditions with my name printed at the bottom and a copy of some statements with a cover letter requesting a payment plan. I then contacted the Citizens Advice Bureau who told me that unless I had a signed application form there is nothing they can do to enforce it and that I should contact the police and get a crime reference number.

After contacting the police, they told me I had to inform the original store card company (Santander) which I did initially by phone. The lady I spoke to was extremely unhelpful when I explained the situation asking me for my card number and password, etc which I would not have before putting me on hold for half an hour before telling me I had to write to them. I then sent a letter to them (to which I have not received a reply) and notified Aktiv Kapital by phone that I have contacted the police and the original card company to which they said they had received the original application form and would forward to me ASAP (which I am still yet to receive).

I also contacted Experian who have put a notice of correction on my file and alerted other credit reference agencies. However, on contacting CallCredit, they sent me my credit file today and it has an entry on the CCJ part saying that a case had been filed in Nov 2009 in Nottingham and is still open. I haven't been alerted to this at all and I'm confused to what I have to do now. I haven't heard anything else from Aktiv Kapital or Santander and am at a loss to how to proceed..

Any help or advice would be extremely grateful!
