They may do, they may not. That would depend on the bailiff.

Again your assuming what the bailiff will do. Not all bailiff's will levy wrongly or illegally.

Yes I am, when it comes to bailiffs I have to assume the worse they can do, not all bailiffs do but the same named companies reappear all the time, claiming false levys visits and charges.

You know and I both know that they will levy on any car on the driveway.
I all have learnt is from others on many sites.

  • You could e-mail them a letter like the one you e-mailed before

    Dear Sirs.

    Reference Number:

I am writing with reference to the above account/s.

As you will know from our records we made an agreement with your company to make payments of £xx per week in relation to the above Liability Orders and to date we have managed with great difficulty to pay £xxx towards these debts.

Our circumstances are that both my husband and I are full time students and we have 4 young children one of whom suffers from epilepsy. I also work part time but my hours have been reduced and I now receive approx £xxx per month for this.

The items of furniture that we own are worth very little and we do not have any savings or means of borrowing money to pay the debts to your company.

The vehicle that I have the use of is vital to my work placement as a social worker and for my part time work as a Care Officer in a children's home. In addition it is vital for my child with epilepsy as unfortunately she has seizures and when these happen she requires immediate hospital care.

We are not refusing to pay our account but the purpose of this letter is to seek your agreement to reducing the payments down to £xx per week instead of £xx per week.

As you will be aware, a bailiff has never gained entry into our home and neither has a levy been made on any goods of ours, for this reason could you please confirm what charges have been applied to each of the above accounts and how much of the liability orders are left to pay

    Yours sincerely

PS: Send by email and also by post.

do i pay the joint one and put the car in my husbands name today so they cannot take the car?

    how do i do this?

is thewre any point sending an email as it says no further arrangements are acceptable and payment is required in full by clear funds only?

also yes i am a student both me and my husband are i am studying social work and he is doing computer networks.

  • Yes, I think an email shows that you are trying to resolve the situation.

Did you get information from them the last time as to how much the charges and LO were for and what was left to pay?

How do you know which ones are paid or not if you don't ask.

Did you find out who your local councillor is and did you email them at all? If not this would be a good time to do it.

My other suggestion would be to speak to bailiffsadviceonline and/or PM RAS or RobertMoir about the car.

They will levy on the car regardless, they levy then ask questions later.

Move the car out of site.

You need to contact the council and find out how much the liability order was for? Then we can see what charges he has put on your account.

Whatever you do, do not let him in your house!!!!!!!!!
    Do not sign anything.

Alternatively google CAG and post on their forum. Bailiff section.

We need to know the exact amount of the LO?

Then as they have never levied or entered property they can only charge £24.50 for 1st visit and £18 for 2nd

    No more than that

  • There is nowhere I can move the car out of site due to where we live. I could put the car on my sister in laws driveway she lives opposite me, can he go onto her property to levy on the car?

I have emailed equata and am waiting for a list of the amounts owed .

    I emailed my councillor
Before who said it was not in
His remit. Is that the right person or should it be my mp who has helped me with student finance in the past ?

Call the council tax line and ask the date of liability order and the amounts of the LOs?

Equata wont respond and if they do they will state all charges are fair.

We need dates of the liability orders and the amounts?

Put it in your supermarket car park, the side of the road - anywhere away from your home.
