    Totally understand your position and sounds like you are being sensible. Do keep the possibility of unenforceability in mind if any did try to get CCJs against you etc (ie if court papers arrive). You have obviously accepted that you will get defaults but if you can avoid CCJs that would be good. Even if you use it at that point you could still choose to continue paying it back but save yourself the harm a CCJ would do (should the debt be unenforceable of course).

  • Like i said MINT are desperate to get hold of my husband signature.. every time we have contacted them by letter and digitally signed it they have come back and said they wont act on it unless its hand signed and twice they have sent a letter asking him to sign in the box .

    Won't act on it unless its hand signed? Thats the biggest amount of rose fertilizer going!

    Partly because a large number of people that borrowed the money from the banks lived beyond their means and didn't keep up their end of the bargain and defaulted on the money they'd borrowed.

    Myself, I agree with "goingforward" and am proud that I paid back every penny that I borrowed and every penny of interested that accrued on that borrowing.

    @unsuremom: It's highly likely that you will end up with defaults on your credit file. I think that so long as you maintain the payments agreed through the DMP then you shouldn't have to worry about CCJs - personally, I didn't have a problem with them - just defaults. However, if you start falling short on those payments then I guess that there is every chance that collection of the debt will be progressed. This is why it's vitally important that you list every conceivable outgoing on your SOA - once your budget has been set, then it's not easy to get it altered in your favour. Obviously, your creditors will always be more than happy to accept increased payments! :)

    Banks write of debts every year but still make massive profits. They still pay out massive bonuses even while the rest of us suffer from their greed.

    It was from the subprime mortgages that started it, too much risky hedging going on and noone to govern them.

    Ok so you borrow some money you spend it you cant pay it back. You agreed to those terms and conditions, you didnt make them up and if the bank scrwed up then why should it be valid. It was their terms and conditions, they gave them to you.

    Would it be morally correct if they gave you T&Cs and then suddenly increased the apr, oh sorry they are already doing that on credit cards. Here is a nice letter stating we are increasing your APR. Morally wrong yes. So stick it back in their face get even, they make millions and millions of profit each year and writing off a few more debts isnt going to make them bust.

    The banks arnt your friends they are there to make moeny and have been for years, now is the time of the consumer with such sites as CAG, Pepioo and here all fighting the corner of the consumer.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    Lol.. i guess they do.. however they have as much chance of us giving them a hand signed letter as i have waking up debt free tomorrow..
  • Thank u to everyone above who posted xx all of the debts are valid and we are in this mess because of consolidating too many times. As yet I have had very few late charges and have never missed a payment but it is very tight. Also I do not have ppi on any. As far as work go I have spoken to compliance and they have told me that I can go down the dmp route as long as I make full disclosure to them. I am unable to go iva as I would definately lose my job. Compliance are aware that I have majority if my debts through Santander and have not said anything different to the above but I will speak again to payplan when they call meback x

    You shouldn't judge anybody by the decisions they make regarding money and debt. If you want to go the UE/CCA route, do it. If you don't then don't.

    If the business/banking world acts in a moral way then fair enough moralise away, the fact is they don't. Never have, never will and they treat people in trouble like dirt.

    You have to do what is right for yourself, no one else.

    Thats what banks do.

    Customer: "Hello mr bank, im in trouble can you help me?"

    Bank: "No"

    Rather than a simple act of compassion where they allow the customer a break they just charge more, default you, send in dca's and worst case off to court.
    Not morally correct imo.
