Problems with a Debt Collector

Hi

Not sure if this is in the right forum, but having some problems with a Debt Collector, and I'm wondering whether what they are doing is legal.

A few months ago I had some issues with EBay and their online payment system PayPal, basically I believe my account was hacked, thereby letting someone gain access to my PayPal account. I reported the incident and there was a lot of two way traffic between me and EBay...or PayPal...and in the end we got the problems sorted.

However, I recently got a letter from a debt collectors working on behalf of EBay, demanding £68 in some kind of back charges.

They claim this goes back to when I lived at a previous address, before the account problems, and that they were only able to track me due to my recent EBay problems at my current address. This old charge was news to me, as I don't remember anyone not getting paid for an item I received from them, and I certainly paid all charges on time.

In any case, I told the Debt Collector that I'd like a record of this in writing, and offered him a home phone number and my new address - to make sure that he could contact me personally if he needed to and also to have the "invoice" sent out. He promised he would.

I asked for the first invoice on a Thursday, and by Monday it hadn't arrived, by Tuesday I'd already had two calls from them again looking for their money. I explained to the assistant that I was waiting for a letter to arrive in the post. By Wed, still no letter, so when they called I asked for another one to be sent out. That still hasn't arrived, and a week later, I've received a call every day at the same time from them asking for payment. Every time I tell them I'd like something in writing, for my own accounts, they tell me that two letters have been dispatched.

I've checked with Royal Mail and my local mail man. Unless he is lying to me and robbing my mail, and delivering everything else on time and promptly, then I don't see why this letter hasn't arrived. I'm also sick of this constant harassment I'm getting from the collection agency. I've told them once I review the invoice payment will be forthcoming, it's not a huge amount, so why the constant calls every day...sometimes at 8.30am in the morning!

Is there anything I can do?:(

In response to the letter they did send you I would send them this prove it letter http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2

I would also send this to ask them to stop all calls and to only communicate with them in writing http://forums.moneysavingexpert.com/showpost.html?p=11571485&postcount=4

  • Hi

Is the DCA you are dealing with is Intrum Justicia?

Tixy has already hit the nail spot on. Send them the prove it letter, and the communication in writing letter.

Ensure you send these via recorded delivery and DO NOT SIGN THE LETTERS. (Digital signature only).

You are absolutely right demanding proof of a debt and no person in their right mind would pay a debt without it.

Do not speak to them on the phone again, simply refuse to answer security questions.

If they discuss your account and divulge information without answering security questions then they are in breach of Data Protection Laws too.
