hi quick question

I have a witness statement and particulars of claim from Wallers who are Northern Rocks solicitors and they have said they will issue a summons against us. I'm assuming that they are now going to claim the property at long last, is there anything I need to do, or just wait for the summons to arrive from the court and confirm to the court that we sent the keys back to NR in July and asked them then to take the property back and want nothing further to do with it

    Just wait for the court papers to come through and reply to them, making it clear that you want the repossession to go ahead.

    The court forms will have sections about your income/expenditure and what payment offer you want to make.

    Those are only really relevant if you are wanting to keep the property.

    So you can either:

    a) Return the court forms leaving those sections blank. With a note about any bankruptcy and that you want repossession to go ahead ASAP.

    Or;

    b) Just write a letter to the court outlining everything, and that you want repossession to go ahead.
