The government is stealing money from me via Student Loans. What can I do?

A few years ago I came into some money and decided to use it to pay off my student loan. After paying it off, money continued to be deducted from my salary. After some correspondence it was admitted that this was in error and I was given a cheque for the value of the deductions. At that point the deductions didn't happen again... until a few months later.

So I contact them again and they apologised for the error and again wrote me a cheque and ensured me that it would not happen again. Another few months passed and everything was fine - until, again another deduction was made. This time I sent them a hand written letter and had it sent via recorded delivery. I made it clear to them that they need to nip this in the bud and that if it was to happen again, I would have to take the matter further because it's theft and because I'm wasting so much time in dealing with them. This seemed to have driven the point home as no deductions were made for an extended period.

I have just been given my wage slip for the month and low and behold, they have taken another sum of money. So now I am looking for advice and options with regards to where I should go from here. It is obvious they either don't listen, are incompetent or both.

I would greatly appreciate any advice you may have, thank you.

your employer must be deducting the money, what have thy got to say?
  • They were the first people I spoke to when this all started over two years ago. They told me that the deductions are taken by HMRC and is not within their sphere of control and that I need to contact the Student Loans Company to put a stop order on the payments. I spoke to them again today and I was told the same thing - it's not something they can do as it's part of the PAYE system.

I was in a similar position, briefly.

It is a shambles of a system.

Basically, your employer is right, their hands are tied. If they have been told by HMRC to made student loan deductions they HAVE TO. They don't get told anything about your student loan, just a simple YES or NO as to whether student loan deductions should be made.

Photocopies of Student Loan paperwork sent to HMRC worked for me - but it is a slow process.

Copy your MP in on a duel letter to HMRC and SLC and send all three registered. Might get noticed then.

Good luck. It's the daftest system I've ever come across.

    A duel letter?

Should your MP bring his duelling pistols or his sword?

If he wins, does the SLC refund the excess payments?
